PAYMENT TERMS: Cash, good check or credit card at conclusion of sale before removal from auction site. Sales tax and 10% buyer premium are added to all purchases. Tax exempt bidders must have current ST3 on file with auctioneer PRIOR to bidding. All bidders will register BEFORE bidding with valid photo ID and use the number issued when identifying themselves as the successful bidder.
ABSENTEE AND PROXY BIDS are always welcome! Call auctioneer at 507-625-7653 at least 6 hrs. before start of auction to pre-register and secure your bid with a credit card. We will make an agent available to bid on your behalf. Absentee/Proxy bids carry a 15% buyer premium and sales tax unless you provide proof of tax exemption when you register. Your card will be charged immediately at the conclusion of the auction if you are declared the winning bidder. If shipping is necessary and/or available for the item you won, you will pay the shipper separately and directly for those charges.
GENERAL TERMS:
1. This is a live on-site auction where everything sells AS IS WHERE IS and all sales are final.
2. It is the sole responsibility of the bidder to inspect the merchandise and/or make inquiries about condition BEFORE bidding by taking advantage of the pre-auction inspection period.
3. Bids cannot be retracted once you have been declared the winning bidder.
4. The auction Clerks records shall be conclusive in all respects. If you did not hear the auctioneers final bid call, the time to ask for clarification is when you have been declared the winning bidder.
5. Do NOT ask checkout staff to adjust the clerks entries on your invoice at checkout. (See #4)
6. This is a privately owned and operated auction facility. No sale or transfer of goods (alley trading) between bidders on our site will be tolerated. Please take your personal dealings off-site.
7. Bids and increments shall advance only as called or agreed to by the auctioneer.
8. Payment in full is due immediately at conclusion of auction and before removal from premises.
9. The minimum opening bid on any item offered for sale is $2.50 unless announced otherwise.
10. Some photos on live auction website featuring groups of items are for advertising purposes only and do not necessarily reflect how they may be offered for bidding.
REMOVAL: All purchases should be removed immediately after the auction as much as possible, or within 24 hours by appointment only with the auction house manager. Any item left on the auction site after 24 hours will be deemed abandoned and will be disposed of or liquidated at the auctioneers sole discretion and no refunds will be issued. If you require temporary storage of an item, we will be happy to quote you storage fees appropriate for the item(s) in question (if we have space available).
LEGAL APPLICATIONS:
1) It is clearly understood that the auctioneer represents the seller only in all transactions and reserves the right to bid on behalf of the seller, absentee and proxy bidders, or other secured parties.
2) Colluding to hold prices down among bidders (bid rigging) is not only contradictory to our obligation to fairly represent the sellers interest, or those of other bidders, it is a felony. Bidders who are caught doing so will have bidding privileges revoked in future auctions conducted by Dailey Realty & Auction Service.
3) Contractual reserves by sellers are sometimes requested on items of high value and we are obligated NOT to disclose the reserve price. Likewise, if the auctioneer determines that any item has not achieved a bid commensurate with its fair auction value, the auctioneer may, at his/her sole discretion reject the bid and withdraw the item from sale unless that item has been advertised specifically as selling with No Reserve.
4) Announcements regarding anything in this sale that are made at the auction take precedence over any and all previously printed or advertised material.
IF TITLED/LICENSED ASSETS ARE OFFERED:
Inspection is offered on the day of auction only. All titled assets have been checked to be clear and ready for transfer before they are offered for sale. Vehicles in running condition will be started by the auction staff prior to start of bidding. Insurance restrictions forbid test drives of vehicles by bidders. Defects that are known to exist and if a mechanical check has been completed will be announced. Ultimately, it is the bidders sole responsibility to run their own VIN and/or Carfax report with the VIN numbers provided in the listing. All vehicles are strictly sold AS IS WHERE IS with no guarantees.
Payment for all titled/licensed assets is due by conclusion of auction and can be made by any of the following means 1) bank wire transfer (within 24 hrs. of sale); 2) cash; 3) pre-approved personal check; or 4) certified bank check. If paying by wire transfer, the transfer must be made within 24 hrs. and an additional $20.00 bank fee applies. Account information for the transfer will be given to the winning bidder.
Buyer Premium for all titled assets is 10% of final sale price with a maximum of $1,500.00 regardless of the sale price. Credit cards cannot be used to purchase licensed vehicles!
Title transfers are completed immediately at the conclusion of the auction or upon confirmation of receipt of wire transfer by Dailey Realty and Auction Service. Registration fees have been calculated by the DMV in advance of the sale and taxes will be calculated after the winning bid amount has been achieved. The buyer premium is added to the bid price and becomes the final sale price for the titled asset for purposes of state tax calculation. Payment for title transfer and taxes is to be made by separate check (can be personal check) made payable directly to the North Mankato DMV. Licensed vehicle dealers are always welcome to bid either in person or by proxy. Please contact auctioneer 24 hours in advance of the sale to register to have a representative bid on your behalf. Title transfer will follow the normal dealer protocol for the State of Minnesota. Any registration and transfer fees should be overnight delivered to Dailey Realty and Auction Service at 360 Pierce Avenue, Suite 212, North Mankato MN 56003. ALL purchasers of titled assets must provide a current drivers license, insurance verification, and dealers license number (if applicable).
Removal Titled asset cannot be removed from the auction site until paid in full (or wire transfer verified) and title transfer paperwork is completed.
All Sales Final and AS IS WHERE IS. While every attempt is made by auctioneer to disclose defects or mechanical problems known to them through photographs or announcements, we do not always have a vehicle history. US Bankruptcy Trustee assets will be announced as such, with no personal knowledge or history of the asset being offered for sale. It remains the sole responsibility of the bidder to inspect in person or make substantial inquiries relevant to the value of the vehicle in the condition it is offered for sale. No refunds or credits will be given once you have been declared the winning bidder. No exceptions.
IF FIREARMS ARE OFFERED: All firearms sales are subject to the following terms and conditions with no exceptions. If you are unable to comply, do NOT bid on a firearm!
All buyers will be required to pass a NICS check and must complete all required paperwork with our licensed FFL of record. The purchaser must have a valid MN Conceal and Carry Permit or a Minnesota Permit to Purchase for all pistols and/or rifles that require this permit BEFORE bidding.
Payment for the firearm payable to Dailey Realty and Auction Service will be made immediately at the conclusion of the auction and the firearm will remain in possession of the FFL until you have completed your NICS check and/or registration of the firearm. NICS checks and pickup of the firearm from the FFL is by appointment only. You will pay a separate fee of $30.00 directly to the FFL at that appointment. If you do not pass the NICS check or have the proper permits to purchase, NO REFUND WILL BE GIVEN, and the firearm will be re-sold on a future auction.

1. The ID you present to the FFL must match the ID you registered for a bidding number at the auction.
2. If paying by credit card, the name on the credit card must match your drivers license/ID
3. Your Permit to Purchase or Conceal and Carry Permit must also match your drivers license.
4. A NICS/Transfer charge of $30.00 (taxable) will apply to each firearm you purchase with no exceptions.
5. NICS check is required regardless of whether you have a Permit to Conceal Carry or Purchase.
Out of State Purchases of Firearms: Federal law requires the FFL to ship purchases of handguns, and/or rifles and shotguns that require a permit, to a Federal Firearms Licensee located in the state of the bidders lawful residence. Please provide our FFL with your preferred destination FFL information to expedite the process. The bidder can only receive the firearm from the destination FFL upon completion of an ATF Form 4473 and a NICS background check. Shipping charges payable to our MN FFL will also apply in addition to your transfer/NICS check fees.
