Conditions of Sale
Upon registering to bid at auction, the Buyer agrees to all Terms and Conditions.
All items are sold 'As is, where is' without any guarantees or warranties of any kind, regardless of any and all statements of condition. Buyers rely solely on their own inspection and information regarding all items. Items are open to the public for inspection. All statements made by the Auction House are considered descriptive only and are not representations of the items. All announcements by the Auctioneer take precedence over prior information (printed or otherwise). Bidders not present at the live auction or who have not previewed items understand and acknowledge that they may not be able to inspect an item as well as if they had examined it in person. It is the Bidder's responsibility to determine condition, age, genuineness, value or and other determinative factor.
The Auctioneer has the sole discretion to advance the bidding and may reject a nominal advance, should it (in his estimation) prove injurious to the auction. The Auctioneer shall be the final judge in all bidding disputes and shall name the winning bidder. The Auction House shall not be responsible for any "missed" bids or bids unseen or unheard by the Auctioneer. If the high bid is simultaneously submitted by more than one bidder, whether online, from the live audience, or as an absentee bid, the Auctioneer will determine the winning bid. Upon the Auctioneer's pronouncement that an item is 'Sold,' the lot becomes the Buyer's property and sole responsibility. The last bid at an auction is an oral contract and is legally binding. All sales are final.
The Auction House shall not be held responsible for the consequences of computer or Internet failure. The Auction House reserves the right to withdraw or re-catalog items in this auction.
Firearms Terms & Conditions
All firearms and ammunition are sold 'As is, where is' without any guarantees or warranties of any kind, regardless of any and all statements of condition, and have not been inspected professionally to verify shooting condition. Sale and transfer of firearms to a buyer are subject to local, state, and Federal regulations. Interpretation and compliance with such rules shall be the sole decision of the FFL verifying the buyer and transferring the firearm, unless there is clarification or specific direction by the appropriate Authority. (Michigan law states that you must be 18 or older to buy rifles or shotguns and 21 or older to buy handguns. Age requirements may vary in other states.)
All firearms must be transferred through a Federal Firearms License (FFL) holder, i.e. licensed gun dealer or gun shop. The Arnold Center Auction House is an FFL holder and can transfer firearms to buyers from their auction house or, for the convenience of non-local buyers, by arrangement with FFL holders throughout the U.S (see Transfer at Other FFL Locations below).
Transferring Ownership at our Location - Once payment for firearms has been made, Firearms purchasers must present a government issued photo ID that is current and shows a valid address and must complete all required paperwork after presenting payment for the firearms purchase. Items will be transferred to the buyer as soon as successful verification can be completed. (Note: ATF rules indicate that buyers may be put on delay for up to 3 days.) It is the responsibility of the buyer to make sure their purchase does not violate any applicable regulations. Please do not bid if you are unsure about qualifying and being able to take possession from your FFL dealer. If a buyer fails to qualify under applicable regulations he/she will own a firearm but will be unable to take possession. If the Arnold Center Auction House agrees to void the sale, the firearm must be returned in unchanged condition and there will be a 35% service charge plus appropriate Shipping and Handling charges.
Transfer at Other FFL Locations - Buyers who cannot personally take possession at the Auction House are responsible for selecting a FFL holder at a location convenient to the buyer. The Arnold Center Auction House must receive and verify a properly documented copy of the receiving FFL holder's license prior to shipping any firearms. Buyer is responsible for fees associated with the transfer and shipping of firearms. Transfers through other FFL holders will be shipped within 3 business days of successful verification and payment of all charges and fees. It is the responsibility of the buyer to make sure their purchase does not violate any applicable regulations. Please do not bid if you are unsure about qualifying and being able to take possession from your FFL dealer. If a buyer fails to qualify under applicable regulations he/she will own a firearm but will be unable to take possession. If the Arnold Center Auction House agrees to void the sale, the firearm must be returned in unchanged condition and there will be a 35% service charge plus appropriate Shipping and Handling charges.
Sale of Ammunition - Ammunition is subject to state and federal guidelines. Sale of handgun to anyone under the age of 21 is not permitted. ** AMMUNITION PURCHASED AT AUCTION MUST BE PICKED UP AT OUR LOCATION. We will NOT ship ammunition!
Titled Items Terms & Conditions
State of Michigan regulations require that we broker all titled vehicles sold through our Auction House. 6% sales tax will be charged for all titled items (unless we are provided with a copy of a valid dealer license). In addition, a $35 application fee and a $15 title transfer fee will apply to each titled item purchased. Unless vehicles are trailered or towed from our facility, we are required to process license plates for titled items. In order to do so, the buyer must provide proof of insurance before we can issue a 15-day temporary registration/plate that will allow the vehicle to be removed. If the appropriate paperwork is not completed in our office on auction day, your title may be delayed.
Buyer's Premium
A Buyer's Premium of 15% will be added to all purchases with a 3% discount given for payment by cash or check.
Invoicing & Payment
Winning bidders will be notified first by AuctionZip. The Arnold Center Auction House will provide buyers with an invoice by the end of the first business day (Monday-Friday) following the auction to verify purchases and provide buyers with an opportunity to arrange for pick up, shipping, or delivery. All items must be paid for in full before they may be removed from the premises. In an effort to expedite service for both our Buyers and Sellers, payment in full is due within five days of the auction. If we have received no response from the winning Bidder within that time frame, the sale may be cancelled and the Bidder may be subject to negative Customer Feedback on AuctionZip which may, in turn, jeopardize ease of registration for future AuctionZip auctions.
We accept cash, check (with photo ID), credit card, or payment through PayPal. In order to protect our customers from fraudulent activities, we must contact you to verify credit card information provided when registering to bid through AuctionZip. Declined payments will be subject to an additional $35 handling fee.
Pick Up & Shipping Terms
Items may not be removed from the premises until paid for in full. Items may be picked up at the Arnold Center Auction House (located at 400 Wexford Ave., Midland, MI 48640), shipped at the Buyer's expense, or delivered (may incur additional fees to be determined by the Auction House). Buyer's will be charged actual shipping cost, insurance fee, special handling fees (if applicable), and a minimal handling/packing fee. Shipments will be combined for multi-lot orders as we are able to do so. Preferred shippers are USPS, UPS, or FedEx Ground, though others may be used upon request. (Attention Ebay Bidders: The Arnold Center Auction House does NOT provide free shipping for any purchases regardless as to what the eBay listing may show.)
Sales Tax
6% Michigan sales tax will be charged on all purchases unless payment is accompanied by a valid sales tax exemption. U.S. coins and currency are exempt from Michigan sales tax. 6% Michigan sales tax also applies to titled item purchases unless payment is accompanied by a valid vehicle dealer license.
