Conditions of Sale

1. All sales are final. No refunds of any kind. All items are sold as found and as is. There are NO REFUNDS so please inspect all lots before bidding by appointment with us.
2. Auctioneer and his agent's verbal statements and written descriptions may not be correct. "Buyer Beware". No warranty express or implied.
3. All items are sold without any guarantee as to history, material made of, condition, provenance, all signatures not guaranteed, age of items is not guaranteed. Please do not bid if you are not able to understand our terms.
4. All items purchased must be paid in full before they are released.
5. Credit Cards are processed Online only. We do not process credit cards at our office .Buyer must pay for the transaction online. Shipping is limited to small items and a separate invoice will billed to you.
6. Ammunition can only be purchased by New Hampshire Residents.
7. Please click on item to see further description and view all images before bidding. There are additional images posted with every item.
8. Buyer pays for all shipping . Buyer must notify us if shipping is requested.We can bring the smaller items to a shipping store and you can pay them directly. We do not quote shipping costs/estimates.
9. Large items are to be picked up on pickup date or by appointment. Must be removed within 1 days after auction closes unless you contact us to make other arrangements. . Pickup time on the pickup date is Sunday June 7th 9AM to noon. Sales sales tax apply to all bidders unless you have filed an exemption with Auction Zip- Invaluable..
SPECIAL TERMS FOR FIREARMS PURCHASES - AUCTION CLOSING June 6, 2026. All purchased firearms must be picked up at the premises of our Firearms Agent, Mike Hashem, at Old Post Office Antiques, 41 Courthouse Square, Ossipee, NH 03864. Telephone: (603) 986-1714. There is a $30 transfer fee payable to the Firearms Agent. All pickups must be by appointment ONLY. Non-New Hampshire residents purchases MUST be delivered to an FFL dealer in their state. Please have the FFL dealer receiving your items send a copy of their valid FFL by email to [email protected]. Items can only be shipped after payment is received for purchase and shipping costs. The Auctionzip/Invaluable system generally does not allow payment to be made through their invoice credit card link for firearms. Payment must be made prior to pickup to Gary Wallace Auctioneers by cash or check at 102 Lyford Road, Brookfield, NH 03872. (603) 767-5276.

Item Pickup

There is NO item pickup on the day of the auction: Item pickup is Sunday Sunday June 7, 9AM to noon. Bring packing materials as none will be available on site. If you cannot pickup your items on the designated day there may be additional charges- call 603-767-5276 to make other arrangements. Item are to be picked at 102 Lyford Rd Brookfield, NH. 03872
Buyers are entering the site at their own risk.

Special Firearms Terms

As there are firearms in this auction, there are special terms and conditions that are in effect relating to firearms.

All Federal, State and Local firearms laws will be strictly adhered to.

FFL holders may take possession of any firearm during one of the designated pickup times that will be posted, (excluding Class III) when they present a signed copy of their Federal Firearms License. If an FFL dealer is sending an "Agent" to pick up items, that person must be a bona fide paid employee of the company with a W4 on file. A signed letter from the FFL holder stating that these facts are true must be presented at the time of pickup. Outside contractors cannot be used as pickup agents. The FFL Dealer will be notified that a transfer was made to you as the agent.

All Firearm pickups MUST be done BY APPOINTMENT through our Firearms Agent, Mike Hashem at Old Post Office Antiques, 41 Courthouse Square, Ossipee, NH 03864. Telephone: (603) 986-1714. NO EXCEPTIONS. There is a $30.00 Transfer fee for each firearm, payable to the Firearms Agent.

Non-resident individuals from states without waiting periods may take possession of long guns during the designated pickup time after completing the proper forms and successfully completing an NICS check. If you reside in a state with a waiting period your items will need to be shipped to an FFL dealer in your state. You must instruct your receiving FFL dealer to email a valid copy of their FFL to [email protected] which must also contain shipping instructions and a valid address.

No modern handguns will be delivered to non-resident individuals. All modern handguns purchased buy non-resident individuals will need to be shipped to an FFL holder in the buyer's home state. Buyer is responsible for any and all shipping charges and all items must be paid prior to shipping. Shipping arrangements must be made through our designated FFL holder, see above paragraph.

Bidders should be familiar with their local and state laws as Gary Wallace Auctions will not be responsible for any parties that purchase items which may not be possessed in or shipped to their state of residence. Some states have restrictions on transfers to Curio and Relic License holders. Please be familiar with your state and local laws before bidding.

Credit Card Chargeback

By accepting approval to bid in a GARY WALLACE Auction, all bidders agree to the following terms: Any bidder who: has been registered with the Auctionzip/Invaluable system for less than two years OR any bidder that has a feedback rating of less than 95% OR Any bidder with any negative feedback involving a credit card chargeback SHALL NOT use any credit card to pay any invoice from Gary Wallace's Auctioneers without our EXPRESS approval. Any item valued at more than $500 that is requested to be shipped shall require SIGNATURE UPON RECEIPT shipping at the buyer's expense. By registering and placing a bid, Bidder agrees to NOT, Under any circumstances, initiate a credit card chargeback with respect to any charges. Bidder further waives any rights to initiate a chargeback that may exist under their credit card agreement. Further, the Bidder acknowledges this chargeback waiver is a material inducement for the Auctioneer to accept the Bidder's registration and allow them to bid. Should any chargeback be initiated in violation of these terms, this agreement shall be conclusive evidence of the bidder's waiver to the bank or credit card company. All property is sold is AS iS with no warranty, guarantee or refunds express or implied. All sales are final once the online auction timer ends. In the event a chargeback is initiated and the charge reversed, the Bidder shall remain liable for the total purchase price, applicable buyer's premiums and all costs of collection or prosecution including reasonable attorney's fees. Further the bidder agrees that the auctioneer shall have his explicit consent for the auctioneer to receive any information related to the bidder, requested from the auction platform or credit card company.

Restricted Payment Items

Any Item that AuctionZip/Invaluable terms a restricted Item such a firearm of knife cannot be paid through the AuctionZip/Invaluable payment system through an invoice. Bidders purchasing any restricted items must pay the auctioneer directly by cash or check. NO credit cards.

Shipping Terms

PAY FOR YOUR ITEMS FIRST. We can deliver your items to Beyond the Box Shipping tel 603-581-4580 for packing and handling.at your expense. Large items such as furniture must be picked up by yourself or designated transit company. Once item arrives to the shipper it is advised for you to call them to arrange details and payment to them for their services.

Sales Tax

If your address is in a state with sales tax and you registered with AuctionZip at that address, their system WILL charge you sales tax with all purchases and shipping that is billed through your invoice. We have NO control over this practice . We cannot make adjustments for sales tax. If you are tax exempt please file a copy of your exemption with auctionzip.
