HENRY LATIMER (1752-1819) 1798 SPECIAL POWER OF ATTORNEY DOCUMENT FOR LAND SALES IN NORTH CAROLINA, legal letter from Henry Latimer of Wilmington, Delaware that grants his attorney William Carthcart of Philadelphia the power to sell all his lands and appurtenances in North Carolina. Henry Latimer shared adjoining land with Robert Carthcart Latimer, William Cathcart, George Latimer, and Richard Dale that totaled 376,000 acres in the counties of Burke and Buncombe, North Carolina. Signed by Henry Latimer on May 1, 1798, with a star papered seal, and witnessed by J. Howell, John Elliott Cresson, and William Walton. Signed and dated by the Mayor of Philadelphia, Hilary Baker, on May 1, 1798, with a star papered seal. Signed and dated by Judge of the Superior Court of Laws and Courts of Equity of North Carolina, Spruce McCay, on February 7, 1799. Signed and dated by District Attorney for Burke County, William Walton, Jr., on March 30, 1799. Dated 1798 and 1799. 19 3/4" x 15 1/4" OA
Catalogue Note: (1) In the 1790s, land speculation in Western North Carolina was out of control, with huge land grants in the hundreds of thousands of acres acquired by men who would never set foot in the state; sometimes, the land grants even overlapped each other. The State legislature was slow to deal with the associated problems, which led to much confusion and many protracted court battles. (2) Henry Latimer was a U.S. Senator from Delaware (1795-1801). He was also a physician who served in the "Flying Hospital," a mobile surgical unit of the Continental Army. (3) Hilary Baker was the 49th Mayor of Philadelphia from October 18, 1796, to September 25, 1798.

  • Condition:

    Paper is in very good condition overall and kept in an archival safe mylar envelope, with three horizontal folds and a center vertical fold. There are some small holes on the central fold and a split on one of the top horizontal folds. There is a series of small holes down the center horizontal fold that could mean it was bound at one time. There are some small folds and tears around the edges due to handling, and some foxing, staining, and discoloration. The ink is very dark, and all the signatures are very legible.
