By registering to participate in Ace of Estates' online sale and/or by placing a bid in such sale, you ("Buyer") explicitly agree to all terms and conditions, which may be updated periodically. This includes the limitations of liability for both Ace of Estates and the Seller. Your continued use or access to this website signifies your acceptance of these changes.
**Condition Statements**
Any condition statement provided is a courtesy to potential bidders or buyers and represents only an opinion; it should not be considered a statement of fact. Ace of Estates assumes no responsibility for any errors or omissions. The absence of a condition statement does not imply that a lot is in perfect condition or free from wear, imperfections, or the effects of aging. Any descriptions provided by Ace of Estates regarding a lot--whether in a condition report, catalog, or on the website--are intended solely as opinions and should not be relied upon as factual representations or warranties. Dimensions and weights of lots are approximate, and our descriptions may not capture all faults or restorations.
Ace of Estates has no obligation to examine, investigate, or conduct tests on each lot to verify the accuracy of any descriptions or opinions provided, whether in the catalog or elsewhere. Bidders and Buyers should not assume that such examinations or investigations have taken place. Each lot is sold "AS IS-WHERE IS," with all faults and defects, and all sales are final. By participating, the Buyer waives any claims against Ace of Estates related to the lot.
**Condition of Lots**
Lots are often second-hand and may be in varying conditions, offered solely for display or appreciation as objects. They are sold to the Buyer on an "as is" basis, with all imperfections. Illustrations and photographs serve only for identification purposes and may not accurately reflect the color or true condition of the lot. It is the Buyer's responsibility to satisfy themselves regarding every aspect of a lot, including authorship, attribution, condition, provenance, history, authenticity, style, period, age, suitability, quality, roadworthiness (if applicable), origin, value, and estimated selling price (including the hammer price).
**Auction Terms**
By bidding at an Ace of Estates auction, you agree to be bound by the following terms:
1. **As Is:** All lots are sold as is, without recourse, and neither Ace of Estates nor the consignor makes any warranties or representations, express or implied, regarding the lots.
2. **Bidding at Auction:** The highest bidder recognized by the auctioneer will be deemed the Buyer. The successful bidder is personally responsible for paying the hammer price, plus a Buyer's Premium of twenty percent (20%) of the gross hammer price, along with any applicable sales tax. Title to the purchased property shall not pass to the Buyer until all wire transfers, credit card transactions, and checks have cleared Ace of Estates' banking facilities.
3. **Buyer's Premium:** All bids are subject to a Buyer's Premium, which is in addition to the successful bid. The auctioneer publishes the Buyer's Premium for each auction in the online catalog and on the website.
4. **Acceptance of Terms:** Any person participating in or registering for the auction agrees to be bound by and accept these Terms and Conditions ("Bidder(s)").
All Bidders must meet the auctioneer's qualifications. Any Bidder who is not a client in good standing may be disqualified at the auctioneer's discretion and will not be awarded lots. This determination may occur at any time before, during, or after the auction's conclusion. The auctioneer reserves the right to exclude any person from the auction.
If an entity places a bid, the individual executing the bid on behalf of the entity agrees to personally guarantee payment for any successful bid.
Accepted Forms Of Payment
We accept all major credit cards, bank wire transfers, money orders, and cashier's checks. However, please note that all payments must clear before items can be shipped or picked up. For international orders exceeding $1,000.00 USD, payment is required via bank wire transfer. Additionally, any shipments--whether international or domestic--sent to an address different from your billing address must also be paid via bank wire transfer.
Full payment is required within 24 hours of the auction's end. If payment is not received, we will charge the card on file on the fourth day after the invoice is sent, unless prior arrangements have been communicated. Items left unpaid for more than five days after the sale will be considered non-collectible, and the bidder will be marked as a non-paying bidder, which may result in a ban from future auctions.
Shipping Terms
Shipping
Most items are eligible for shipping. Each listing includes a flat-rate shipping price for delivery within the Continental U.S. If a shipping price is not listed, it's likely that the item cannot be shipped. If you win multiple items, we will make every effort to combine them for shipping and apply a discount to the total shipping cost. However, please note that large and/or fragile items must be shipped individually.
International Bidders/ International Shipping
All invoices exceeding $1,000.00 USD must be settled through bank wire transfer. We can arrange shipping through a third-party shipper. Please note there are size limitations for each country that we can ship to. If you are unsure, please email and we can verify if it is within the acceptable dimensions. Also, some items may have shipping restrictions to your country. It is your responsibility to verify the legality of the item in your country or state before placing a bid. We will not ship items that are subject to restrictions. Shipping costs will be billed separately after payment for the auction items is received. We will combine and discount shipping fees where applicable.
