Your bid is an irrevocable offer to purchase the asset.
Each bid is subject to the terms and conditions below. "You", "your", "buyer", "bidder" refer to the auction account of the individual who bids on the listing. You are liable and responsible for any and all bids made through your account. You will be required to produce a certified police report documenting fraud if you suspect unauthorized access to your auction accounts which results in a purchase. Otherwise, Land Ho, Inc. shall enforce the terms and conditions that form this document.
Your offer is irrevocable and binds you to these terms and conditions which become a contract upon acceptance by Land Ho, Inc. Land Ho, Inc. shall accept the offer on or about the closing time of the auction, except in auctions where a reserve price in included and not met. Land Ho, Inc. reserves the right to cancel any bids without notice for any and all reasons, including, but not limited to buyer having previous history of non-payment to Land Ho, Inc. or one of its affiliates.
UNLESS OTHERWISE SPECIFIED, TAXES OR FEES WHICH MAY BE OWED ON ANY PROPERTY IN THE AUCTION ARE THE RESPONSIBILITY OF THE BUYER AND EACH BUYER IS ENCOURAGED TO MAKE HIS OWN INDEPENDENT INVESTIGATION AND IS ENCOURAGED TO CONSULT AN ATTORNEY.
ALL PROPERTIES SOLD IN "AS IS" CONDITION WITH ALL FAULTS AND DEFECTS WITHOUT WARRANTY OR GUARANTEE OF ANY KIND. BUYER(S) RESPONSIBLE FOR VISITING PROPERTIES AND ALL DUE DILIGENCE ABOUT LOCATION, ENCUMBRANCES, ACCESS, MINERAL RIGHTS OR LACK THEREOF, WATER RIGHTS OR LACK THEREOF, ETC. PRIOR TO SUBMITTING ANY BIDS! FURTHER, NEITHER LAND HO, INC. NOR ITS AGENTS, MAKE ANY REPRESENTATION AS TO THE SUSTAINABILITY OF ANY PARCEL FOR A PARTICULAR USE.
Transfer of properties is not done via title insured closing, unless arranged for in advance of the auction by bidder and agreed to by seller and the cost of which is borne by bidder.
SHOULD YOU BECOME A WINNING BIDDER AND FAIL TO CONSUMMATE THE TRANSACTION(S) IN THE STIPULATED TIMEFRAME, YOU AGREE IN ADVANCE TO PAY AS LIQUIDATED DAMAGES 150% OF OUR LEGAL AND COLLECTION COSTS. BUYER CONSENTS TO EXCLUSIVE JURISDICTION IN THE STATE AND/OR FEDERAL COURTS OF NEW JERSEY OR BINDING ARBITRATION AT LAND HO'S OPTION AND AT BUYER'S EXPENSE. BUYER, BY BIDDING, WAIVES ANY JURISDICTIONAL DEFENSES TO ANY SUIT FILED IN THE STATE OF NEW JERSEY. SHOULD BUYER BID BUT FAIL TO PAY IN THE STIPULATED TIMEFRAME FOR ANY REASON, BUYER HEREBY CONSENTS TO GRANT TO LAND HO, INC. ENTIRELY AT LAND HO'S OPTION, EITHER ONE THIRD OF THE TOTAL AMOUNT DUE PLUS 100% OF ALL FEES AND PREMIUMS, AS LIQUIDATED DAMAGES OR SPECIFIC ENFORCEMENT PLUS ATTORNEY'S FEES AS STIPULATED ABOVE.
By bidding, buyer expressly agrees to be held responsible for anyone bidding on buyer's computer or through buyer's auction account. A 3% charge may be assessed for any Paypal transactions.

NO CREDIT CARD CHARGEBACKS: Each Bidder agrees to NOT, under any circumstances, initiate a credit card chargeback with respect to any charges.
Each Bidder further agrees that if, in violation of these Terms and Conditions, a credit card chargeback is initiated by the Bidder, these Terms and Conditions shall be conclusive evidence of the Bidder's (i) agreement to not initiate a credit card chargeback and (ii) waiver of any rights to initiate a credit card chargeback. Each Bidder acknowledges and agrees that on the Auctioneer's presentation of these Bidder Terms and Conditions to the bank, credit card company, or other financial institution that issued the credit card on which the disputed charges were made, such bank, credit card company, or other financial institution shall deny any credit card chargeback and shall re-credit all amounts to the account of the Auctioneer.
If a Bidder initiates a credit card chargeback, such Bidder, even if successful, shall remain liable for all purchases made at the auction and shall be responsible for all costs and expenses, including any attorneys' fees, storage fees, packaging and handling fees, transportations fees, and/or disposal fees, etc., incurred by or on behalf of the Auctioneer or Seller in challenging the credit card chargeback. Each Bidder agrees that the agreement to not initiate a credit card chargeback is a condition to the issuance of a Bidder Number to the Bidder and is being made as an inducement for the Auctioneer to accept the Bidder's Registration and to issue a Bidder Number.
Bidders' Responsibility: You are responsible for all bids made from your account. If you believe that an unauthorized person has gained access to your account, you must notify the Auctioneer immediately by sending an e-mail to [email protected]. You must also report the incident to the relevant law enforcement authorities and send the Auctioneer a copy of any resulting police report. You understand and agree that if you do not promptly report any suspected fraud to the Auctioneer and to the relevant law enforcement authorities, you will be held personally responsible for all purchases made using your account and bidder number.
