Two page bi-fold from the bound volume of GENERAL ORDERS / War Department / 1865. The volume contained original General Orders issued by the Union War Department during the Civil War. The orders bound in chronological order from January 7, 1865 through January 30, 1866. Page size 5" x 7.25", with two punch holes to the left margin. Orders typed on recto and verso. Near fine.

This four-page document from the book contains "General Orders No 73 issued from the War Department, Adjutant General's Office, Washington, April 24, 1865".

With the official orders put in place by James Speed, Attorney General of:

"Sir: I have the honor to acknowledge the receipt of your letter of the 22d of April. In it you ask me three questions, growing out of capitulation betwixt general Grant … and General Lee of the rebel army.

You ask First. Whether rebel officers who once resided in the city of Washington and went to Virginia or elsewhere and … too service, can return to the city under the stipulations of the capitulation…

Second. Whether persons who resided in Washington  (who) .. left the city.. where they adhered to the rebel cause .. Can return to Washington … and reside here under the terms of the capitulation?

Third. … Rebel officers have appeared in public in the loyal States wearing the rebel uniform; and you ask where such conduct is not a fresh act of hostility...

Your letter is accompanied with a copy of the terms of capitulation entered into betwixt Generals Grant and Lee. It is as follows:"

As one reads the review of the orders, one is struck with awe at how complicated the period post war, post capitulation must have been to pull the country back together and reconstruct:

"… It follows as a matter of course that residents of the territory in rebellion cannot be regarded as having homes in the loyal States. A man's home and his residence cannot be distinct from the one from the other … As belligerents to the Government of the United States  … the officers and soldiers of General Lee's army, then who had their homes prior to the rebellion, in the Northern States, took up their residences within the rebel States and abandoned their home in the loyal States; and when General Grant gave permission to them, by stipulation, to return to their homes, it cannot be understood as a permission to return to any part of the loyal states …"

A phenomenal piece which shows the orders and confusion during the period just after capitulation.
