2 - SALES PART 3. GENERAL OBLIGATION AND CONSTRUCTION OF CONTRACT § 2-328. Sale
by Auction.(1) In a sale by auction if goods are put up in lots each lot is the subject of a sell.
(2) A sale by auction is complete when the auctioneer so announces by the fall of the hammer or in other customary manner. Where a bid is made while the hammer is falling in acceptance of a prior bid the auctioneer may in his discretion reopen the bidding or declare the
goods sold under the bid on which the hammer was falling. 3) Such a sale is with reserve unless the goods are in explicit terms put up without reserve. In an auction with reserve the auctioneer may withdraw the goods at any time until he announces completion of the sale. In
an auction without reserve, after the auctioneer calls for bids on an article or lot, that article or lot cannot be withdrawn unless no bid is made within a reasonable time. In either case a bidder may retract his bid until the auctioneer's announcement of completion of the sale, but
a bidder's retraction does not revive any previous bid.(4) If the auctioneer knowingly receives a bid on the seller's behalf or the seller makes or procures such a bid, and notice has not been given that liberty for such bidding is reserved, the buyer may at his option avoid the
sale or take the goods at the price of the last good faith bid prior to the completion of the sale. This subsection shall not apply to any bid at a forced sale. the auctioneer reserves the right to bid, whether it is on behalf of any minimums, reserves or for their own personal purchase.
The highest approved bidder to be the buyer. In all cases of disputed bids, the property shall be resold but, Auctioneer will use their judgment as to good faith of all claims and his decision is final. Where a lot has stated quantity that is more than 1 (one) , the bid shall be multiplied times the quantity to determine the total cost of the lot unless other wise noted. All bidders are required to register and give full identification prior to the beginning of the auction and are required to use the number issued them when identifying themselves as the successful bidder. All purchases by attendees shall be paid in full by close of auction, and preferably removed same day. Any items not removed within 48 hours of auction /sale shall be deemed abandoned by bidder and shall be disposed of at bidder's expense without recourse. Bidders who wish to pay by check may be subject to procedures to verify their check has cleared before removing merchandise from the auction house. Checks and payment items not approved are subject to a $25.00 returned item fee imposed immediately and added to the check out total. A successful bid at auction, whether life or online, constitutes a legally binding contract of sale. All sales are final. All lots are sold subject to Nevada State sales tax unless bidder has filled out a Nevada state sales tax exempt certificate and such certificate is on

Every item sold "as is" Neither the Auctioneer nor the seller makes any warranties or representation of any kind or nature with respect to said property. All sales are final. Catalog descriptions are for simple identification purposes only, no representation are made as to authenticity, age, or origin, or value. Buyer relies solely on his/her own inspection and judgment when bidding.
When purchasing firearms requiring a federal background check, you are solely responsible for knowing the laws in your jurisdiction. NO refunds will be made in error. THERE ARE NO REFUNDS ON FIREARMS.

We will contact you for payment information after the conclusion of the auction as federal law is that the webcast service can not give us your credit card information, this is only taken by them to validate that you are a real bidder.
Special Terms
1. All items are offered for sale 'AS IS', 'WHERE IS', and no special warranty or guarantee is made or implied as to condition, authenticity or era of any described item. THE AUCTIONEER OR AUCTION HOUSE ASSUMES NO LIABILITY FOR BREAKAGE OR DAMAGE AFTER THE FALL OF THE GAVEL. THE ACCEPTANCE OF A BID BY THE AUCTIONEER CONSTITUTES A LEGAL AND BINDING CONTRACT WITH THE BUYER AND ACCEPTANCE OF THE TERMS AND CONDITIONS OF SALE UNDER NEVADA STATE LAW. All items are offered for sale to the highest bidder and the bidders must establish to there own satisfaction the authenticity and condition before bidding. All items offered for sale are by auction only and there are no presales. We have a responsibility to our consignors; therefore, there will be no sales after the said auction. The Auctioneer or Auction House assumes no responsibility for error in the catalog, advertising, or on the part of the bidder. ALL SALES ARE FINAL, NO REFUNDS, NO EXCEPTIONS. 2. Nevada Sales Tax is payable by all buyers liable to tax. All Dealers must provide a valid resale number upon registration prior to bidding for Tax Exempt Status. 3. All bids are per number in the catalog and all items will be sold in numerical order only. AUCTION HOUSE reserves the right to withdraw any item or lot prior to sale. Absolutely no lots will be broken apart. The highest bidder will prevail. The Auctioneer will regulate the bidding and reserves the right to refuse any bid not believed to be in good faith. Should any disputes arise between bidders, the decision of the Auctioneer in the exercise of judgment as to the successful bidder will be final. Additionally, the Auctioneer may re-offer or resell any lot in dispute. 4. Auction sales are strictly for cash, cashier's check, or personal check with prior approval, Visa, Master Card, Discover Card, ATM or Debit Card. All Sales are final at the fall of the Auctioneers gavel. A Buyers Premium will be charged on all sales. There will be a $75.00 fee for all returned checks. All checks over $5,000 must be pre- approved. All 'INTERNET' bidders must pay by Credit Card. 5. All items purchased by the successful bidder must be paid for on the day of sale unless previous arrangements are made prior to the sale. Purchases not paid within 14 days of final sale date will be charged a 5% Late Charge, all accounts past due will accrue interest at the rate of 1.5% per month on the unpaid balance and compounded monthly. Items purchased must be removed on the day of sale unless other arrangements have been made. Storage will be provided at no charge for 14 days following the sale date and then at a rate of $5.00 per item per day unless prior arrangements have been made. 6. Shipping is the responsibility of the Buyer and the Buyer must make all 'Shipping or Delivery' arrangements on large items which may include calling a freight company. We ship exclusively with FEDERAL EXPRESS and U.S.P.S. Smalls will be packed and shipped by us at the buyer's expense. Small crated items, by us, will be quoted prior to crating & shipping. Shipping charges other than exact costs INCLUDE: (1)Insurance is the responsibility of the buyer and is required for all packages (no exceptions).
