1. Buyers responsibility to inspect items before purchasing:
All properties are sold as-is and all sales are final. It is the responsibility of the buyer to inspect all items before purchasing.
2. buyer's premium of 25%
3. In-house shipping :
Our in-house shipper Gravity Boxes will automatically send paid buyers an invoice/quote separately by the email on the buyers invoice after invoices are paid
3b. Furniture that is too large for the US Postal System cannot be mailed by in-house shipping. Buyers will need to outsource a third party shipper.
4. Storage fee:
Merchandise that is not picked-up within 14 days after the sale will be removed from the Auction by Gravity Boxes. Gravity Boxes will charge the buyer a removal fee of $25 U.S. Dollars per invoice and daily storage charge of $5 per day per lot will commence regardless of lot size or value.
5.Neglected Items
Any and all items that are either paid or unpaid which are not picked-up, not paid for storage, and/or paid to be shipped within 30 days of the auction will become property of the auction or Gravity Boxes without refund.

By bidding at the auction whether present in person, by agent, written bid, telephone, internet and/or by other means, the buyer agrees to be bound by the conditions of sale as follows..

All properties are sold as-is and all sales are final.
Neither the consignor nor Donny Malone Auctions can assure any warranties or representations with respect to any lot sold including but not limited to the correctness of the catalogue description, the physical condition, size, quality, rarity, attribution, authorship, importance, medium, provenance, exhibitions, literature or historical relevance, and no statement anywhere, whether oral or written, shall be deemed such a warranty or representation.


All sizes listed are approximate.

Prospective bidders should inspect the property before bidding to determine its condition, size, and whether or not it has been repaired or restored. The consignor and Donny Malone Auctions disclaim any and all warranties expressed or implied including but not limited to the implied warranty, merchantability, or fitness for any particular purpose. No warranties are made that any of the merchandise complies with any applicable governmental rules, regulations or guidelines of any kind or nature whatsoever. Neither Donny Malone Auctions as agent nor the consignor is responsible for any faults or defects in any lot nor to the correctness of any statement as to the authorship of any origin, authorship, date, age, attribution, genuineness, provenance or condition of any lot.


2. Payement
A buyer's premium of 25% on any amount bid will be added to the purchase of all lots in the sale.
This premium is payable by the purchaser as part of the total purchase price.

All bids placed and all payments made must be in U.S. Dollars drawn on a U.S.Bank unless payment in U.S. Dollars wired from a foreign bank has been pre-arranged. Internet bills may be paid via Paypal with Paypal funds or credit card.


All invoices which are not paid one week ( 7 days) after the sale will be canceled and an unpaid dispute will be sent. Buyers will be who are subject to unpaid invoices will be suspended/blocked for future auctions.

3. Shipping Information,
WE DO NOT SHIP
Shipping is the buyers responsibility and is at the sole discretion of the buyer.

We offer an in-house shipper Gravity Boxes to cut down costs and time for items to be shipped out. Gravity Boxes will mainly send items via UPS unless stated with a po box for USPS. Shipping invoices will be sent separately by email, on file on the buyers invoice, as in the form of a paypal invoice. Invoices can be paid by paypal funds or by credit/debit cards, including visa, discover, and mastercard.
Pricing calculation and estimates:
Shipping is calculated by the quote system on the UPS website plus packaging materials plus 20% for labor. (math example , 42 quoted + 4 for the box = 46 * 1.2 labor = 55.2, the buyer will be charged 55.2)
Paintings over and near 45 inches will be crated.

If your item is too large for the U.S. Postal Service: The buyer is responsible for arranging pick-up or delivery of merchandise at buyer's risk and expense. All arrangements may be made through the buyer's own shipper. We cannot provide estimates, you must obtain your own by contacting your choice of shipper.

4. Right to refuse service
As a private business Donny Malone Auctions reserves the right to refuse, deny, cancel , or terminate any/all sales without excuse or reason. Sales that are not completed will be refunded and then terminated.


5.Neglected Items
Any and all items that are either paid or unpaid which are not picked-up, not paid for storage, and/or paid to be shipped within 30 days of the auction will become property of the auction or Gravity Boxes without refund.
Unwillingness to pay storage fees will result in a termination of the buyers purchase(s) with no refund and items will become property of Gravity Boxes. It is not the responsibility of the auction to retrieve the buyer?s merchandise that is purchased, paid or unpaid.
