The "Message from the President of the United States" dated February 10, 1857 (cataloged as Senate Executive Document No. 41, 34th Congress, 3rd Session) is an official executive transmittal by President Franklin Pierce. The core document transmits official correspondence and records requested by the U.S. Senate regarding Governor Isaac Stevens' controversial proclamation of martial law in Washington Territory. The Core Issue: In 1856, during conflicts between white settlers and Native American tribes (the Puget Sound War), territorial Governor Isaac Stevens declared martial law to forcefully detain white settlers he suspected of sympathizing with local tribes. The Constitutional Clashes: The territorial judiciary fiercely opposed the declaration. When Judge Edward Lander attempted to hold court to issue a writ of habeas corpus for the detained settlers, Governor Stevens ordered territorial volunteers to enter the courthouse and arrest the judge himself. The Congressional Inquiry: The U.S. Senate passed a resolution demanding all executive records regarding the incident. In response, President Franklin Pierce submitted this executive document. It includes letters, transcripts, and a formal review by the Secretary of State and Attorney General, ultimately rebuking Governor Stevens' actions as unconstitutional.
