PICKUP & REMOVAL NOTICE: Pickup is available on the scheduled date and time only, please review the removal schedule before bidding and plan ahead. Buyers are responsible for bringing their own help and all supplies needed to pack and secure items for transport; Auction Company staff will assist when possible, but buyers should plan assuming no staff assistance will be available. The Auction Company offers in-house shipping at the Buyer's expense (actual postage plus a $20.00 per-package handling fee, with lots combined into as few packages as possible); buyers who prefer to arrange their own third-party pack-and-ship service may do so at their own expense prior to the auction closing. Items not collected or scheduled for shipping during the scheduled pickup window will be considered forfeited.

Directions: Take Exit 125 (Saltwell Road/Shinnston Exit) from I-79. If traveling from the north (southbound on I-79), turn right off the exit ramp onto WV-131/Benedum Drive. If traveling from the south (northbound on I-79), turn left off the exit ramp onto WV-131/Benedum Drive. Travel northwest on Benedum Drive for approximately 1.5 miles, passing the BFS & Exxon stations on your right. Your destination at 5508 Benedum Drive will be on the right side of the road. Watch for Auction signs.

ONLINE PERSONAL PROPERTY AUCTION TERMS
Auction Structure & Registration: This auction is presented in two sessions, Session 1 and Session 2. By registering to bid in Session 1, the Buyer is automatically registered to bid in Session 2. At the conclusion of Session 1, invoices will be generated for items won in that session, and any eligible credit card on file will be charged for payment. At the conclusion of Session 2, items won in that session will be merged with the Buyer's Session 1 invoice to create one unified invoice, and any eligible credit card on file will again be charged for payment.
Bidding Errors: All bids are binding and final once a lot has sold. Bids cannot be deleted or removed after a lot has closed. The Buyer is advised to review all bids on the review page prior to submission. Outbid notifications are provided as a courtesy only; the Auction Company, Seller, licensees, agents, and employees bear no responsibility for errors, omissions, or timing of outbid notices. The Auction Company reserves the right to refuse off-increment bids.
Online Bidding Disclaimer: The Auction Company utilizes third-party bidding platforms to facilitate the collection and recording of online bids. By agreeing to these terms, the Buyer agrees to hold harmless the Auction Company and all bidding platform providers for technical errors and mistakes arising from connectivity issues on the part of the Auction Company or the Buyer.
Closing Lots: Lots will begin closing at the published time on the date specified. Not all lots close at the same time, and closing method, speed, and intervals vary by session as described below.
Session 1 will use a cascading closing method: a lot will not begin closing until the lot immediately before it has closed. A lot will remain open, and will continue accepting bids, until there has been no bidding activity on that lot for 30 seconds.
Session 2 will use a timed soft-close method: no lot will close until there has been no further bidding on that lot for 30 seconds. Lots will close one at a time at a rate of approximately one lot every 20 seconds, with the Auction Company's goal being to complete the entire Session 2 catalog in approximately 4 hours or less.
Buyer's Premium: A 15% Buyer's Premium applies to all online personal property purchases.
As-Is, Where-Is: All items are sold on an As-Is, Where-Is, With All Faults basis without exception. No warranty of any kind, expressed or implied, is offered as to the fitness or merchantability of any item for any purpose. Items offered may be new or used. Used items exhibit some level of wear, damage, or defect by virtue of prior use. Items represented as new may have been subject to storage, handling, display, or other conditions prior to the auction and are not guaranteed to be free of defect. The Auction Company and Seller expressly disclaim any warranty of merchantability or fitness for a particular purpose. No sale shall be invalidated by reason of any defect, inaccuracy, misdescription, or cataloging error. All marketing materials and descriptions are provided as a guide only and are not guaranteed to be complete or accurate. The Buyer holds the sole obligation and duty to inspect all items during the inspection period prior to bidding. By bidding, the Buyer accepts all items regardless of any defects or conditions, known or unknown, visible or not, and forever releases the Seller, the Auction Company, licensees, employees, and agents from any and all claims. No bids may be withdrawn during or after the auction for any reason. These terms may only be amended by written agreement signed by the Auction Company. No oral, written, or electronic representation by any party shall modify these terms.
Inspection: All items are available for inspection prior to the auction closing, either in person or virtually through provided photographs and descriptions. By bidding, the Buyer acknowledges having had a full and fair opportunity to inspect the item and agrees to rely solely on the Buyer's own inspection, whether in person, through a proxy, or based on provided photographs, in determining whether or not to bid and how much to bid.
Coin & Numismatic Item Descriptions: Auction Company staff are not professional coin graders or numismatists. Descriptions of coins and other numismatic items are prepared to the best of our layman's ability, and all metrics and details noted in the description are those we are able to observe using the resources available to us. Descriptions should not be relied upon as a professional grading, authentication, or appraisal of any item. If the Buyer is not comfortable with the quality, content, or description of an item, the Buyer should not bid on that item.
Removal of Items: Local pickup is available on the designated date and time only. Scheduled removal windows are firm and no exceptions or accommodations will be made for any reason.
Pickup for this auction will be by appointment only, easing congestion and chaos at the pickup site. Pickup appointments will be scheduled on a first-come first-served bases using an online scheduling form made available at the conclusion of Session 2. Because this auction is presented in two sessions, Buyers who win items in Session 1 will not be able to schedule their pickup appointment until both sessions have concluded. Once both sessions have concluded, a scheduling link will be emailed to all winning bidders, allowing them to select their desired pickup appointment time. All bidders will receive access to the scheduling form at the same time, via email, at the conclusion of Session 2. If you must have a particular time for pickup, please monitor your inbox closely and schedule your time promptly when the form is opened before others have a chance to take the time your desire.
The Buyer must bring adequate help to load items and all necessary packing supplies, including boxes, packing materials, and any other materials needed to properly secure items for transport. Auction Company staff will assist with packing and loading when possible; the Buyer should plan and arrive assuming no staff assistance will be available.
Items not retrieved or scheduled for shipping during the scheduled pickup window will be considered forfeited.
Shipping: The Auction Company offers in-house shipping at the Buyer's expense for items not collected in person; shipping charges are calculated as actual postage plus a $20.00 per-package handling fee, and lots will be combined into as few packages as possible. Buyers who prefer to arrange their own third-party pack-and-ship service may do so at their own expense and without the Auction Company's involvement; items must be collected by the pack and ship provider during the pickup window unless prior arrangements with the Auction Account Representative.
Forfeiture: Forfeiture is defined as the Buyer's relinquishment of all ownership and claim to items to the Auction Company with no expectation of reimbursement. The Buyer who forfeits items remains fully responsible for the invoice total. No refunds will be issued in the event of forfeiture. Any items not retrieved by the removal deadline are considered forfeited. The Buyer who wishes to formally forfeit items must contact the Auction Company on or before the removal deadline.
Payment: Invoices of $2,999.99 or less will be automatically charged to the credit card on file at the conclusion of the auction. If the card is declined, the Buyer will be contacted within 24 hours to arrange alternate payment; where a card on file has been declined, payment at pickup may be made by cashier's check or money order.
Invoices of $3,000.00 or more require payment via cashiers check, money order, wire transfer, or cash. Credit cards are not accepted for invoices at this level, except for face-to-face payment at pickup, where staff can verify the identity of the cardholder in person.
For invoices of $3,000.00 or more where the Buyer is requesting shipping, credit card payment will not be accepted under any circumstances, due to the fraud risk associated with shipping high-value items paid by card without in-person verification. Payment must be made via cashier's check, money order, or wire transfer only. Wiring instructions will be provided upon request only after a qualified invoice has been created.
The invoice must be paid in full before the Buyer takes possession of, or before the Auction Company will ship, any items. Business or personal checks are accepted only with valid photo identification and Auction Company approval. Business or personal checks of $10,000.00 or more must be accompanied by a Bank Letter of Credit. Cash payments at pickup are discouraged.
Choice of Venue / Jurisdiction: By registering to bid and accepting these terms, the Buyer agrees and consents to the exclusive jurisdiction and venue of the Circuit Court of Harrison County, West Virginia for all disputes arising out of or related to the auction process and sale. The Buyer waives all jurisdictional and venue defenses and affirmatively submits to the exclusive jurisdiction of that Court.
