Auction Terms:

This is an online-only auction. By registering for this auction and bidding you agree to all the terms and conditions listed above & below.

1. All merchandise is sold lien-free.
2. All items with a transferring title are subject to $25 processing fee and all taxes will be paid to your county of registration, titles will be mailed out within 10 days after the items are removed from location. In-state residents that purchase titled equipment/vehicles can transfer titles locally with the seller once payment has been received and checks have cleared @ county court clerk’s office during business hours. All others will be mailed within 10 days as mentioned above.
3. All tax exemptions must be sent to the office prior to invoices being paid. No refunds will be given for sales tax exemptions once payments are processed. Please inform us if you are tax exempt. Resale certificates must be on file with the Auction Co. in advance of sale day. Ky sales tax is 6%. NOTE: (all titled vehicle taxes will be collected at the time of registration NOT AT THE AUCTION)
4. Occasionally an item must be removed from the auction due to circumstances beyond our control. If there is an item that you are interested in, please call ahead of time to ensure that it is registered into the auction.
5. Shipping Instructions: All buyers are responsible for the shipping of items won.
6. Preview Date & Times: Previews are available daily on any equipment located at 3300 Wayne Sullivan Dr. Paducah, KY 42003. Staff will be on-site with keys to operate & demonstrate equipment on 2 different days. Saturday, August 1st from 10 AM – 12 PM. & Saturday, August 8th from 10 AM – 12 PM. All other smaller or miscellaneous items will be available for preview by appointment only through the auction company (270) 444-0031
7. Payment Time Frame: Payment on all large equipment exceeding $2,500.00 is due in full within 72 hours (3 days) of close of auction by certified cashier’s check or wire transfer. Credit card payments of $2,500.00 or less will be processed within 24 hours of the closing of the auction. No in-person bidding. Once payment is received purchasers will have 10 business days to remove merchandise/equipment.
8. Invoice: Paid invoice receipt notifications may be automatically blocked or put into a deleted / junk / spam folder. It is the bidder's responsibility to contact us regarding their invoice total if it is not received within a 24-hour period.
9. Catalog: The online listing catalog is to be used as a guide and guide only; its accuracy cannot in any way be guaranteed or warranted. No sale shall be invalidated or void, nor shall auctioneers be liable for any inaccuracies in the catalog and each bidder assures that all lots were available prior to the offering for pre-inspection prior to bidding. 3. When the bidder bids on an item and the Auctioneer/software recognizes & accepts the bid, it is a LEGALLY BINDING AGREEMENT, and as such is not removable.
10. Auctioneers shall not for any reason be responsible for loss, theft, or damage of any kind to any items purchased, the items security and protection solely reside with the purchaser once item has been paid for by guaranteed funds, wire transfer or credit card.
11. The amount owed to the Auction Company will be carefully and accurately represented and shown on a Company generated invoice, no 3rd party invoice or receipt communications shall be considered binding nor accepted as amount owed. Invoice will be sent to purchaser/s disclosing total purchase price.
12. Wire transfers by online bidders are preferred within 3 business days from auction conclusion. Cashier’s Checks issued on heavy equipment, trailers & vehicles must be delivered on a business day, during business hours & be accompanied with a bank letter of guarantee on all invoices. Credit cards will be processed by the close of the next business day once invoices are delivered to purchasers by email. All purchases will be subject to all fees and taxes associated. 13% Buyer's Premium in effect. 6% KY sales tax.
13. If payment is not received by the designated time mentioned above in the terms and conditions the buyer may be expected to pay late penalties and up to or including being reported to Proxibid for nonpayment and you will be blocked from any further bidding.
14. All items are subject to being pulled from the auction up to and including day of the auction for any reason that Auction Company deems fit, without prior notification.
15. All items are expected to be picked up within 10 business days following the auction. Any items not picked up within the described window and/or prior arrangements have not been made and acknowledged by the Auction Company in writing, will incur storage and handling fees. After 30 days from the auction date the items will be sold ABSOLUTE in our next auction and at the new owner's expense. All fees and charges including storage and commissions will be deducted from the sales price, and the balance will be sent to them in the form of a company check mailed to their address on file.
16. Warranty: All items are sold as-is where-is, no warranties expressed or implied nor suggested in relations to the condition, merchantability, or usefulness of any item offered for sale. Buyers are completely responsible for inspecting items prior to the auction and know the condition before purchasing. Online inventory and any auction day catalogs are guides only, auction company is not responsible for incorrect information online or in catalogs. The Auction Co. uses the most up to date resources to collect all info for specifics. Special preview appointments can be made by calling Chris Colson Auction & Realty Co. All information is gathered from what is believed to be reliable sources and is believed to be correct but not guaranteed. Bidders will hold harmless Chris Colson Auction & Realty Co. LLC and its representatives. Chris Colson Auction & Realty Co. LLC assumes no liability for errors or omissions in the listing including year models, usage measurements (hour meters, tachometers), they are represented but unverified information and accuracy is not guaranteed. 18. Auctioneers reserve the right to refuse any bid for any reason which they consider to be an insignificant advance over the preceding bid or is not in the best interest of the Seller.
19. Pre-inspections are always welcomed and encouraged. Items will be available for preview based upon the times noted in the terms. Previewing the items is always recommended prior to bidding as all bidders are solely responsible for personally inspecting the item and verifying any information presented here or elsewhere. Items and their descriptions are subject to change, correction, updating and/or cancellation at any time without notice.
20. This auction is being performed online only by an independent 3rd party, and as such the functionality of the third party’s site is in no way the responsibility of Chris Colson Auction & Realty Co. LLC, thus no bidder may hold Chris Colson Auction & Realty Co. LLC responsible for missed bids, electronic transmissions sent from the 3rd party, nor technology challenges experienced prior to, on the day of auction, nor after the auction. Electronic communications between you, the bidder and the bidding platform are just that communications between you and the bidding platform. Chris Colson Auction & Realty Co. LLC is in no way liable nor expected to honor the automatically generated communications from 3rd party entities. It is encouraged to guarantee your bid is received that you place your maximum bid via the proxy bid option 24 hours in advance.
21. It is the Bidder's responsibility to know which item they are currently bidding on, the item becomes the property of the winning bidder, and it is their personal responsibility to protect and maintain the integrity of the item. The Auctioneer nor auction company takes any responsibility for the items once it has been sold.
22. No items will be released under any circumstances unless all costs, fees and taxes are paid in full and all signed paperwork if any has been returned. This is an absolute auction. ALL SALES ARE FINAL!
23. By registering for this auction, you are authorizing Chris Colson Auction & Realty Co. LLC to use for their sole discretion with your contact information to collect balances and contact you for promotion or advertising.
24. All disputes or legal matters, if any should arise will be addressed in mediation prior to other proceedings and will be conducted in Paducah, KY.
25. Chris Colson Auction & Realty Co LLC is licensed and regulated by the KY Board of Auctioneers.
