TERMS OF SALE — PLEASE READ

The following terms and conditions apply to all bidders, whether bidding online or in person. By registering to bid, you are entering into a contractual agreement with Mountain Man Auction House, LLC and accepting all terms of sale.

Buyer’s Premium: 10% On-Site - 12.5% Online

Sales Tax: A 5.3% Virginia sales tax will be added to each invoice unless a valid tax-exempt certificate is provided to Mountain Man Auction House, LLC prior to payment. Tax exemption form for resale: ST-10

Registration: Registration is free. All bidders must register with a valid driver’s license or state ID.

Removal: To avoid storage fees, all purchased items must be removed within 5 business days of the auction. Please contact us prior to sale day if special removal arrangements are needed.

Payment Terms: We accept: Cash, Check, Wire Transfer ($10 wire fee), Credit/Debit Cards (4% additional fee) - Wiring instructions will be provided upon request.

Late Payment: Any invoice not paid within 24 hours will be subject to an additional 10% late fee.

IMPORTANT CONDITIONS

• All sales are final.
• The highest bidder is responsible for purchasing the item they bid on.
• All items are sold AS IS, WHERE IS, with no warranties expressed or implied.
• There are no returns or refunds under any circumstance.
• It is the buyer’s sole responsibility to verify all information, inspect the vehicles, and determine condition and suitability prior to bidding.
• All information provided is believed to be reliable, but is not guaranteed by the auctioneer, auction company, or seller(s).
• Inspection and verification of all advertised information is solely the responsibility of the buyer.
• The auctioneer reserves the right to accept or reject bids and to set bid increments.
• Announcements made on auction day take precedence over all previously advertised statements or announcements.
• Inventory is subject to change.

TITLES / VEHICLE INFORMATION

Unless specifically announced otherwise, or marked “No Title” or with another disclosed title status, each car or truck is presumed to convey with a clear title. Please note: The tractor does not have a title.

It is the buyer’s responsibility to conduct any title, ownership, VIN, or vehicle history research prior to bidding.

COLLECTION / NON-PAYMENT

Winning bidders will be responsible for any and all collection efforts and costs incurred by Mountain Man Auction House, LLC in the event of non-payment, including but not limited to:

• Attorney fees
• Filing fees
• Collection fees
• Other related recovery costs

ADDITIONAL DISCLOSURES

Most vehicles are used infrequently by the seller(s), and equipment is subject to changes in hours, condition, and operability by sale day. Any significant changes known will be announced on auction day. Bidders are strongly encouraged to inspect all items prior to bidding.

The auctioneer, auction company, and employees may state or advertise item information as their opinion only. The buyer is solely responsible for making their own determination as to the condition, state, value, and operability of all items sold.
