Auction House:
(Auction house name removed as per forum rules)

February 17, 2013, 12:30 PM EST | Saint Marks, FL, US
Lot 1A | 1967 FORD FAIRLANE NO RESERVE REGARDLESS OF PRICE
they did not honor my bid cap of 8000 dollars i placed on line prior to bid opening day and now claim the lot #1A i purchased was sold to an in house on site bidder for the same amount, coincidental?
what is my course of action?
please advise.

He has every right to sell it that way. Many auctioneers will sell to the floor over the online bidder. Who placed a bid first does not matter. This is where perception gets us in trouble. The winning bidder is the one who is recognized by the auctioneer. This is generally considered the right way to sell to reward those for showing up at the live sale. That is all I have to say I'll shoot this topic off to Ray and let him defend himself.

well i saw the on line end results that day of lot #1A it caped @ $3,900. that makes me the highest responsible bidder. the on site bidder has the right to out bid me sure. but his bid should be more than my cap not equal to the same. and that sale should be reflected at that time.

there no point to biding on line if the auctioneer is not going to honor the guidelines of his own site terms.
and selling after the lot has closed is a totally unethical of practice.

i would invite ray (as you mention) to have a open forum conversation of what transpired on this auction.
and im sure he would not mind a open review of the minuets of this lot for discussion. as he was very vaige on the phone and had very few words in reply.

thank you for your input Mr

I have People Leave Me Bids All the Time, And Sometimes They Get Outbid On the Exact Dollar Amount They Left. Say You Leave Me $500.00 on a Item, Someone in the Room Starts it For $200.00, The Bidding Goes Back & Forth, Your Bid is $450.00,The Bidder in the Room Hits $500.00 ...Guess What? Your Max of $500.00 Has Been Outbid By Someone in the Room....I can See How this may Happened to Ray. Trust Me, If Ray Could Get more Money out of You, Or Anyone Else (As all Auctioneers Do) He is Going to do It!

sales or accepting offers after the sale is unethical of practice.
im saying the lot is was closed. that makes the sale final.

I am the owner of RM Sales. First off I want to lash out at the online bidder for attacking me in an open forum. But I am going to try to understand his thought process. He left a 8k limit. I think he believes since his left bid was first he automatically is the first one to bid 8k. And that may be true against other online bidders.

This is the sequence of events. The floor was at $7500 the AZlive bid was taken at $7750 the floor bidder bid $8000. Then there were no further bids. The auction house did not even know you were willing to bid $8000, your high bid was aromatically surpassed. If it is any consolation the floor bidder declared it was going home with him before the auction regardless of price. I believe the floor bidder would of gone to 20k if pushed.

Please call AZLive customer service if you need a better explanation.

AZLive does not tell the auctioneer what the max left bid is. It is for the protection of the bidder. There are other online services that do tell the auctioneer what the left bid is. I had an item go for $400 I knew had a left bid of $4000 on. I honored the bid, but twitched a little bit.lol

Again sorry you did not get the item you wanted. We want your money. In short your tied the floor, but the floor bid was taken first. And sincerely thank you for your bid and wish the sequence was different.

I hope this makes sense to you. If not would another auctioneer please try to explain this. I want to bidder to honestly know he was not cheated.

Auctioneer Ray McNamara

Shame on the guy for identifying you on this forum. In my opinion AZ should have deleted his post because doing that is a violation of forum rules and is simply in bad taste.

For the bidder: Keep your disagreements in private. I hope the explanation the other auctioneers made sense to this online bidder. I do not sell online, but I do take absentee bids and sometimes the person in attendance just happens to bid the amount that was the absentee bidders high bid. It happens, and it is offensive to level charges of dishonesty towards anyone unless you have solid proof and I don't think you can provide that and if you can talk to your attorney and/or the auctioneer. It does not need to be slammed around in this forum.

I myself Tried To Explain how Things Work At My Auction House, Then He Had To Thank Me Very Sarcasticly Using My Full Name And Location.........Ray, I'm Sure Glad He was Your Bidder And Not Mine.....Well, After That Auction, He May not Be Your Bidder Either. So We Both Win! LoL
