Conditions of Sale
REGISTRATION:
• All bidders must register and obtain a bidder number in order to participate in the auction.
• A credit card is required to register, bidders are encouraged to register with a credit card to expedite your purchase payments and shipping. A credit limit of $5,000 will be issued. If you require a larger credit limit you must call our office for verification. If you do not wish to register with a credit card number please call 575-623-7355 to register. Your credit limit will be reduced to $100.00 due to risk factor.
• Customers without prior credit approval who intend on making purchases in excess of $10,000 must provide credit information such as a bank letter of credit prior to bidding.
BIDDING:
• Bidding on any item in the sale indicates the bidder's full acceptance and understanding of all terms and conditions of sale.
• There will be a Buyer's Premium of 15% added to all online bids.
• 10% for telephone/absentee bids or in-house bids. Absentee and Telephone bids may be placed by calling our office
@ 575-623-7355. A Credit Card is required for all telephone bids.
•Wild West Auctions, LLC has taken great care in the preparation of the descriptions in this catalog. Although we believe everything in the descriptions to be true, we do not guarantee any part of any description. We recommend that the bidders view the items in person and form their own opinions as to condition, originality, origin, etc. We are human and sometimes miss a flaw or problem
with a specific lot. Announcements made during the auction will supercede written documentation.
• Internet buyer's are cautioned about bidding on items that have not personally been able to inspect. Refunds will not be given due to buyer's inability to inspect items prior to auction. Items that have not been viewed in person will not be eligible for refund. Be certain you are able to live with these terms before bidding on any of the lots being sold. We would rather you NOT bid on any of our lots then to receive something you would not be happy with and expect a refund.
• The auctioneer has sole discretion in the case of a dispute among bidders.
• Internet bidders are cautioned to leave proxy bids to ensure that their bids are received by the auction house in case of internet connections and or other internet related issues. There are sometimes delays in reception which could cause a bid to not be received from an internet bidder before a lot is sold.
• Any items that are sold with title and paid for other than cash, will require us to hold title until full payment has been made and check or credit card has cleared the bank.
• All items sold by Wild West Auctions, LLC are sold AS/IS, WHERE IS, NO WARRANTIES EXPRESSED OR IMPLIED.
• NO REFUNDS, NO RETURNS FOR ANY REASON.
• Wild West Auctions, LLC reserves the right to reject any bid in order to protect our consignors interests.
PAYMENTS:
• Wild West Auctions, LLC will accept cash, check, MasterCard, Visa, Discover & American Express. Wild West Auctions, LLC reserves the right to demand cash or hold merchandise until funds are collected in full on such items as titled vehicle.
• Customers without prior credit approval who intend on making purchases in excess of $10,000 must provide credit information such as a bank letter of credit prior to bidding.
• Once the auctioneer awards a lot to the highest bidder it is your sole responsibility to pay for your auction purchase, purchases each day. If you did not provide a credit card number at registration and CVV code, you MUST contact Wild West Auctions, LLC
@ 575-623-7355 and provide Credit Card number and CVV code with 24 hours to pay for your purchases.
• There will be a $25 fee for any and all returned checks.
PICKUP OF ONLINE AUCTION ITEMS:
• Online bidders are encouraged to contact Wild West Auctions, LLC as soon as possible after the auction ends to make arrangements to pickup any auction items they do not want shipped.
• We will do our best to accommondate requests to HOLD auction items. Arrangements must be made in advance.
SHIPPING:
• There will be a $5.00 per box surcharge, plus exact shipping costs applied to each package shipped. We will combine items as much as possible. If more than one box is needed a $5.00 surcharge will apply to each box used.
• We are not professional shippers. We do our best to protect and package all items to the best of our ability. In the event that an item arrives damaged, it is the buyer's responsibility to notify Wild West Auctions, LLC with 5 days of receipt.
• Claims shall be handled by the terms and amount of coverage applied to each package and by the requirements of each carrier.
• It is not our desire to make money off the shipping & handling charges. We recycle so our boxes and materials may be used but still in good condition.
• ALL ITEMS MUST BE SHIPPED INSURED. INSURED VALUE WILL BE DETERMINED BY INVOICE TOTAL PLUS SHIPPING & HANDLING COSTS.
• Any larger items that cannot be packaged & shipped by Wild West Auctions, LLC is the responsibility of the buyer to arrange for shipment of furniture or any larger items.
• We usually ship items within 2 business days of auction end unless payment has not been made or credit card has been declined.
• Our preferred method of shipping is Federal Express. We reserve the right to ship via other companies as deemed necessary.
• We will NOT ship to Post Office Boxes. A physical street address is required to ship any item or items.
• Any bidder may request that their items be packed and shipped by a professional packing company at the buyer's expense. Wild West Auctions, LLC must be notified with 24hrs after the auction if buyer will be requesting this type of service. Otherwise all items will be shipped as specified above.
GUIDELINES FOR FIREARM PURCHASES:
• All Federal, State and Local firearms laws will be observed. FFL holders may take possession of any firearm on day of sale when they present a signed copy of their Federal Firearms License. New Mexico residents over the age of 21 may take possession of any
firearm on day of sale providing the proper paperwork is filled out and the transfer has been approved either through the NM State
Police or the FBI NICS System. While most NICS and State approvals are immediate, approvals could take up to 5 days. Most non-residents may take possession of long guns on day of sale after completing the proper forms and successfully completing a NICS check; modern handguns will need to be shipped to an FFL holder in the buyer's home state. Buyer is responsible for any and all shipping charges and all items must be paid for on day of sale. Once a firearm has been shipped to a FFL HOLDER, Declined bidders will not be issued a refund and the firearm may become the property of the FFL holder that the firearm was shipped to. Bidders should be familiar with their local and state laws as Wild West Auctions, LLC will not be responsible for any parties purchasing items which may not be possessed in, or shipped, to their state of residence.
