SUMMARY OF TERMS AND CONDITIONS - please be sure to read all the Terms and Conditions listed below before bidding.
1. All property is sold "as-is", "where-is" and all sales are final.
2. A 17% Buyers Premium will be added to the final bid price to determine the final selling price.
3. All items MUST BE PAID FOR AND PICKED UP OR SHIPPED WITHIN 14 DAYS of Jones Auction House, LLC sending an invoice to Buyer. Items not paid for or not picked up after 14 days will be forfeited back to JONES AUCTION HOUSE, LLC. A $25.00 fee for storage and handling will be charged to the Buyer of the the forfeited item regardless of the size of the item. NO REFUNDS WILL BE ISSUED. The item will be returned to the Seller promptly or relisted for auction.
4. All items are described to the best of our knowledge; however, neither we nor our consignor(s) make any warranties. Please see photos of the items as we took great measures to assure that they reflect the true conditions we have described of the items. Photos are also considered a description/inspection of the item. By bidding in the sale, you agree that you are satisfied with our description whether accurate or errant. By placing a bid through this website, you are entering into a legally binding contract and agree to follow through with the purchase of the item should you win the item. Once a bid has been submitted, it cannot be retracted or changed. JONES AUCTION HOUSE, LLC assumes no responsibility for incorrect or missing listing information. All information is taken from sources believed to be reliable, but not guaranteed to be accurate. Item listings and descriptions are subject to change, update, or cancellation at any time without notice. All Bidders agree that their own decision to bid and the amount they bid has been based solely on their own independent inspections and evaluations of the items.
It is your responsibility to understand the pickup and, if available the delivery options and costs for each item before you place your bid. All bids are shown in US dollars and all taxes, buyer premiums, pickup, shipping, and handling charges are additional. A bid by any person shall be proof that the person has read these conditions of sale and has agreed to be bound by them. The Bidder expressly agrees not to stop payment, dispute or contest this transaction. JONES AUCTION HOUSE, LLC and its consignors reserve the right to remove any and all items from a sale at any time. Bidder agrees to hold Jones Auction House harmless for the failure to execute a bid for any reason on behalf of any participants.
Payment terms are Check, Credit card, ACH or cash upon pick up. ($20.00 transfer fee for wire).
ALL PURCHASES WILL BE SUBJECT TO Pennsylvania SALES TAX of 6%. SALES TAX WILL BE CHARGED ON THE HAMMER PRICE AND BUYERS PREMIUM. If Buyer is Tax Exempt, a tax exemption form must be filed with us before an exemption can be made.
"ALL SALES ARE FINAL. NO RETURNS/REFUNDS. JONES AUCTION HOUSE, LLC shall have no responsibility for any error or omission. The absence of a condition statement does not imply that the lot is in perfect condition or completely free from wear and tear, imperfections or the effects of aging.
All items must sell through the auction process. This is not a retail purchase and all items/lots are sold "as-is", "where-is", without any warranties whatsoever, where express, implied or statutory. Expressly excluded are warranties of fitness for use, purpose, and direction. In the event that there are technical difficulties related to the server, software or other online auction-related technologies, JONES AUCTION HOUSE, LLC reserves the right to extend, continue or close the bidding. Neither the company providing the software nor JONES AUCTION HOUSE, LLC shall be held responsible for missed bids or failure of the software to function properly for any reason.
JONES AUCTION HOUSE, LLC reserves the right to cancel this auction or remove any item/lot from this auction prior to the close of bidding. JONES AUCTION HOUSE, LLC reserves the right to reject any and all bids for any reason. An accepted bid is a legal binding contract.
JONES AUCTION HOUSE, LLC reserves the right to resell any and all personal property that is not paid for in full by the conclusion of the stated pickup dates. In case of such an event, the Bidder will still be responsible for payment for the original purchase and the costs of collection of this payment and/or damages resulting for the resale of the property.
- Buyer/Bidder agrees to hold harmless and indemnify JONES AUCTION HOUSE, LLC and its agents, owners, employees and its representatives from any and all claims, damages or suits including but not limited to awards, judgments, costs, fees, etc. EACH PARTY HEREBY KNOWINGLY, VOLUNTARILY AND INTENTIONALLY WAIVES (TO THE EXTENT PERMITTED BY APPLICABLE LAW) ANY RIGHT IT MAY HAVE TO A TRIAL BY JURY OF ANY DISPUTE ARISING UNDER OR RELATING TO THIS AGREEMENT AND AGREES THAT ANY SUCH DISPUTE SHALL BE TRIED BEFORE A JUDGE SITTING WITHOUT A JURY IN THE STATE OF PENNSYLVANIA.
- The identity of all bidders will be verified. JONES AUCTION HOUSE, LLC reserves the right to reject the bidder's registration if there is any question as to the person's credentials.
Bidder responsibilities include, but are not limited to:
- Bidders agree to keep their username and password confidential, as they are responsible for ANY and ALL activity involving their account.
- When using the website you must obey any and all local state and federal laws. Violations will result in termination of web site use privileges.
- By submitting a bid in the name of a business entity or corporation, the individual submitting the bid enters into a guaranty agreement whereby he or she personally guarantees payment to JONES AUCTION HOUSE, LLC of any bid amount not paid when due by the business entity or corporation, for any reason, together with all collection expenses incurred to enforce collection, including a reasonable attorney's fee. If, for any reason JONES AUCTION HOUSE, LLC is unable to make available any Purchase, or portion thereof, or documentation required in respect to any purchase at time of pickup, the sole liability of if any, shall be the return of any paid monies in respect of such purchase upon its return by purchaser.
- If an item is not picked up by Buyer upon last pickup day, it will become property of JONES AUCTION HOUSE, LLC and buyer will risk future bidding by being blocked from auctions.
By bidding on any item, Bidder agrees to all terms and conditions set forth….
- Payment must be made before item(s) are removed or shipped.
- JONES AUCTION HOUSE, LLC will automatically charge the Bidders credit card on file for items purchased, plus shipping after 48 hours of invoices being sent via email to Buyer.
- ALL SALES ARE FINAL. NO RETURNS OR ADJUSTMENTS WILL BE MADE.
- IF PAYMENT HAS NOT BEEN RECEIVED BY THE LAST SCHEDULED PICKUP DAY OR 14 DAYS FROM RECEIVEING THE INVOICE, IT WILL BE CONSIDERED IN DEFAULT.
- All items MUST BE PAID FOR AND PICKED UP OR SHIPPED WITHIN 14 DAYS of Jones Auction House, LLC sending the invoice to Bidder. Items left after that time will be forfeited back to JONES AUCTION HOUSE, LLC. NO REFUNDS WILL BE ISSUED. The item will be returned to the Seller or relisted for auction.
- JONES AUCTION HOUSE, LLC reserves the right to charge $25.00 back to the Bidder for relisting, storage and handling fees.) Items are to be picked up on the arranged pickups day(s). If you are not able to do so, you must notify JONES AUCTION HOUSE, LLC and other arrangements must be made ASAP. Any specialized arrangement for pickup outside of the scheduled dates will be subject to an additional $25 fee.
- Upon default, the Bidder may be blocked from bidding on any future JONES AUCTION HOUSE, LLC online auctions.
- The bidder agrees to pay all reasonable attorney fees and other costs incurred by JONES AUCTION HOUSE, LLC in its efforts to collect unpaid funds from the bidder. The bidder agrees that a late fee of two percent (2%) of the outstanding balance per month will be added to any unpaid balance due to JONES AUCTION HOUSE, LLC.
- Items not picked up or claimed for shipment are abandoned to the auctioneer after 14 days of JONES AUCTION HOUSE, LLC sending the invoice to Bidder.
- Your bid must adhere to the bid increment schedule. Bids do not include the Buyer's premium, taxes, shipping or 3rd party shipping.
A photo ID may be required before credit card Purchase's. Any dispute will be tried in a court of jurisdiction in LACKAWANNA COUNTY, PENNSYLVANIA.
*** SALES TAX *** If you are a tax exempt we must have your tax number on file BEFORE the end of the sale. Otherwise, all bidders pay standard sales tax rate of 6%. Please read, no exceptions: On pickup day, Bring your PRINTED paid or unpaid invoice and tax exemption form if needed. Please bring your own boxes and any help needed to carry your purchases.
Credit Card Fee
There will be a 3.5% Surcharge fee when using a Credit Card as a form of payment. This is in addition to the buyers premiums listed.
Payment
Invoices will be emailed to the successful bidder within three business days of the auction. YOUR PAYMENT IS DUE UPON RECEIPT OF YOUR INVOICE.
a) Due to the uncontrollable nature of the delivery of email, if you have participated in an auction, you are encouraged to inquire to see if you were a successful bidder. Non-receipt of an emailed invoice does not preclude you from your responsibilities for payment.
b) We Accept Money Orders, checks, and cash in person at Auction House.
c) If making payment by check or money order, please notify us to avoid and double charges.
d) If we do not hear from you within 2 days of Jones Auction House, LLC sending your invoice, we will charge the credit card listed on file.

Shipping Terms
Buyer pays actual shipping and handling.
Small items shipping will be USPS first class, priority mail, or brought to a UPS packing and shipping store.
We do not ship large items such as furniture etc…
You may pick up your items at the auction house.
Pick up days and times are:
- Tuesdays from 11 AM until 4 PM
- Wednesdays from 11 AM until 6 PM.
Unless other arrangements are agreed upon.
Please contact us for international rates before bidding.
Insurance is available at Buyers expense.
Buyer is responsible for arranging pickup and shipping for large items.
All items must be picked up within 14 days from time invoices are sent.

Taxes
Buyers are required to pay Pennsylvania state tax of 6% unless exempted by law. If exempt, buyers must file a tax exemption form with us before any exemption can be made.
