1. All sales are final. No refunds of any kind. Please inspect all merchandise before bidding.
2. Auctioneer and his agent's verbal statements and written descriptions may not be correct. "Buyer Beware". No warranty express or implied.
3. All items are sold without any guarantee as to history, material made of, condition, provenance, all signatures not guaranteed, age of items is not guaranteed. Please do not bid if you are not able to understand our terms.
4. All items purchased must be paid in full before they are released.
5. Credit Cards on file may be charged four (4) days after an invoice has been sent.
6. Ammunition can only be purchased by New Hampshire Residents.
7. Pickups of items purchased at the October 26 auction will be: Wednesday, 10/27, 9AM-2PM, Thursday 10/28 from 9A - 2P; Friday 10/29 from 9AM - 2PM and Saturday 10/30 from 10AM to 2PM. If none of these times work for you contact us to make other arrangements after the close of the auction but no calls on Tuesday October 26, 2021.

Terms and Conditions - Firearms Auction
We do not guarantee any items we are selling or listing including: age, signature, history, material or condition. We provide ample time for buyers to examine the articles and make their own determination prior to bidding. Our written and verbal descriptions may be incorrect and we will not issue any refunds therefor the bidder is responsible for their bids. We make no warranty express or implied.
We charge all bidders a 20% buyers premium which includes a 5% charge added by the auction hosting company as their fee.
All items must be paid in full before they are removed from the premises or shipped. If you choose to have items shipped you must contact us and so advise us. Please do not assume an item will be shipped without contacting us.
Payment may be made via the Auction-Zip system invoice, or upon pickup by cash, check, Mastercard, Discover or Visa credit cards.
As there are firearms in this auction, there are special terms and conditions that are in effect.
All Federal, State and Local firearms laws will be strictly adhered to.
FFL holders may take possession of any firearm during one of the designated pickup times that will be posted, (excluding Class III) when they present a signed copy of their Federal Firearms License. If an FFL dealer is sending an "Agent" to pick up items, that person must be a bona fide paid employee of the company with a W4 on file. A signed letter from the FFL holder stating that these facts are true must be presented at the time of pickup. Outside contractors cannot be used as pickup agents. The FFL Dealer will be notified that a transfer was made to you as the agent.
New Hampshire residents over the age of 21 may take possession of any firearm during the designated pickup times provided that the proper paperwork is completed and the transfer has been approved either through the New Hampshire State Police or the FBI NICS System whichever is appropriate based upon the type of firearm(s) purchased.
Non-resident individuals from states without waiting periods may take possession of long guns during the designated pickup time after completing the proper forms and successfully completing an NICS check. If you reside in a state with a waiting period your items will need to be shipped to an FFL dealer in your state.
No modern handguns will be delivered to non-resident individuals. All modern handguns purchased buy non-resident individuals will need to be shipped to an FFL holder in the buyer's home state. Buyer is responsible for any and all shipping charges and all items must be paid prior to shipping. Shipping arrangements must be made through our designated FFL holder.
Bidders should be familiar with their local and state laws as Gary Wallace Auctions will not be responsible for any parties that purchase items which may not be possessed in or shipped to their state of residence. Some states have restrictions on transfers to Curio and Relic License holders. Please be familiar with your state and local laws before bidding.
Firearm Types:
Antique (Prior to 1898): No paperwork needed
Modern: Post 1898 firearm which requires an FFL or 4473 with corresponding successful background check in order to be delivered.
Curio & Relic (C&R) firearms that fall under the ATF Curio & Relics licensing and if purchased by a person with a C&R license then no paperwork is required. Note: items that meet the age requirements but have been altered or modified from their original configuration may not be delivered to a C&R license holder.
NOTE: We do on occasion, pass on coin grading that was on holders. We do not guarantee ANY grade or authenticity unless coins are graded by PCGS or NGC.
Pickup & Shipping Terms
Items may be picked up at our location. We strongly urge that you pickup your items. Pickup times will be posted.
If you are going to require shipping, please DO NOT assume that we will ship your item without contacting us. Please contact us via email after the auction closing to request shipping. Please put "SHIPPING" in the title line of the email request.
Items that we ship will be shipped via UPS or USPS. All items that we ship will be insured for the final price on the item invoice. No exceptions. Purchaser is responsible for all shipping and related charges. ALL COSTS FOR THE ITEM(S) AND SHIPPING MUST BE PAID BEFORE THE ITEM IS SHIPPED.

In some cases, items might be delivered to a UPS or FEDEX shipping location for packing and shipping. Buyer will pay all shipping charges and accepts all liability for shipping. We will furnish your information to the shipper who will then contact you.
