    1.BINDING CONTRACT: This sales contract shall be binding between the Seller and successful high Bidder/Buyer. This auction will be conducted in conjunction with the laws and bylaws of the Oklahoma Real Estate Commission (OREC) and the bylaws of the Northeastern Real Estate Services (NORES). Announcements the day of the Auction take precedence over any printed matter or statements previously made regarding this property for sale at this address on auction day.
    2. PROPERTY SOLD AS IS, WHERE IS: This property is being sold AS IS-WHERE IS. It is the sole responsibility of the Buyer to have satisfied themselves with the current condition of this property before bidding. By signing the registration agreement, you have accepted these Terms & Conditions. The Buyer, Buyers Agent, or Both agree they have had the Pre-Auction opportunity, to inspect this property, had a representative inspect the property. The buyer has viewed the disclosures, disclaimers or any other documents that are available. The Seller or Auctioneer makes no guarantees, warranty, representations or opinions as to the condition of this property. This is to include but not limited to accessories, additional equipment, appliances, attachments, easements, encroachments, equipment, fixtures, improvements, machinery, property boundaries, survey, square footage or warranty of merchantability.     3. THERE ARE NO CONTINGENCIES: By submitting a bid at this Auction, the Buyer acknowledges that they are satisfied with the condition of the property. There will be no contingencies or conditions to this purchase. Contingencies are to include but not limited to; the ability for a Buyer to perform, ability to secure a loan, property condition, inspections, health, legal opinions or any other conditional act that would not allow the Buyer to perform and close the sale of this property. The final highest bidding price will be announced as "closed the bidding" by the auctioneer, after the highest and final bid has been received. The high bid and backup bidders will be recorded. If the first bidder cannot perform, the second bidder may be offered the property for purchase on auction day or thereafter at Auctioneer's discretion. The winning bidder will be required to execute an Oklahoma Real Estate Contact no more than 24 hours after being notified as the winning bidder. The winning bidder will also be required to deposit $5000 on the day of execution of contract. These funds are NON REFUNDABLE unless for any reason other than if the Seller cannot comply with delivering a clear title on the property as mentioned in Paragraph 6. These funds will be held by McGraw Realtors in their trust account. If the buyer cannot fund the purchase in the required timely manner as specified in these Terms & Conditions, PLEASE--DO NOT BID ON THIS PROPERTY.
    4. FORFEITURE OF EARNEST MONEY: In the event of default to perform on behalf of Buyer, in connection with this Property sale, following an Auction conducted hereunder, Seller agrees to accept any alternative sale procured by the Agent/Auctioneer/Broker during the Closing Period after default by the Buyer so long as the principle terms and conditions of such alternative sale are no less favorable than the terms and conditions of the original sale in connection with which the Buyer default occurred and the purchase price meets or exceeds the Reserve Price in the context of a Listing for Sale With Reserve. Forfeited earnest money, to the extent allowed by applicable law, shall be determined, divided and distributed by the Broker, McGraw Realtors.
    5. FEES PAID BY THE BUYER: ESTIMATES OF CLOSING COSTS Closing Fee ($300) Title Exam ($300) Recording Fees ($70) Title Insurance ($550-$750) Title Insurance Binder ($75) Buyer's Name Check ($25) Final Abstracting ($250). There may also be bank fees associated with any loan the Buyer is acquiring. An accurate "Cost To Buyer sheet" will be calculated at the time of execution of Contract. These costs are ESTIMATES ONLY of the closing costs and are in no way to be relied upon.
    6. SELLER TO DELIVER CLEAR TITLE: Prior to the Closing Date, the Seller, at the Seller's expense, shall furnish merchantable, clear title. Seller shall be subject only to reasonable utility easements and building restrictions of record and other exceptions specified in the Sales Contract. This real estate transaction will be scheduled to close 30 days after the auction contract is completed.
    7. BUYER FEE OR PREMIUM: There is a 6% Buyer' Premium in addition to the winning bid. The 6% Buyer's premium will be due upon the successful closing of the home and will not be considered part of the total sales price for appraisal purposes. The Buyer's Premium is only paid upon a successful closing of the transaction.
    8. BROWNE AUCTION SPECIALISTS/Ron Browne a Real Estate Associate with McGraw Realtors will act as the Seller's Agent for the seller and the Buyer's Agent for the buyer unless the buyer has an agent who has pre-registered with the Auction.
