NOTICE OF PUBLIC AUCTION: In accordance with Chapter 42 of Title 2A and specifically, pursuant to N.J.S.A. 12A:9-601, et. seq. and New Jersey’s Abandoned Tenant Property Statute (N.J.S.A. 2A:18-72 through 2A:18-84), and to satisfy a Landlord’s lien for rent arrears, please take notice that TOPPS HOLDINGS, LLC, (Lienholder) on Wednesday, October 31, 2019 starting at 9:00 A.M. shall sell at public auction at 930 Newark Avenue, Jersey City, New Jersey the following property left abandoned by Craig Lopez: Contents of former leasehold of Craig Lopez in Units T-525, T-505, and T-521 consisting of collectible music albums, CDs, other collectibles, novelty items, bric-a-brac, household goods, decorations (“Leasehold Contents).  The Secured Party reserves the right to bid at sale, set upset price, reject any and all bids, and cancel, reschedule and adjourn the auction, shall not be required to post a deposit, and may credit against the purchase price bid all amounts due it. The successful bidder shall be required to pay the full purchase price at the time of the sale, in cash only. Should the successful bidder fail to so deliver the purchase price, the Lienholder reserves the right, in its sole discretion, to resell the Leasehold Contents, and any loss arising from such re-sale shall be the responsibility of the defaulting successful bidder. Contents must be removed within (4) calendar days of the sale with access provided by Lienholder with twenty-four (24) hours prior notice at (201) 918-2131. All bidders must post a $250 deposit to participate in auction which amount may be adjusted later upon completion of the auction at the sole discretion of the Lienholder.  In addition, a refundable clean-out deposit of $250.00 will be required to be posted by each successful bidder(s) at the conclusion of the auction to assure the complete removal of all contents.  Said deposit will only be returned if the unit has been completely emptied within (4) calendar days of the auction date or same will be retained by the Lienholder.  All sales are final.  The sale may be subject to such further conditions and provisions as may be announced at the start of the sale. The Leasehold Contents shall be sold “as is”, “where is”, without warranties, express or implied, and subject to superior liens, if any.
