I have been authorized by Kay Sherman Cobb and Billie Paul Cobb, as Co-Executrix/Co-Executor of the Estate of Helen Rains, to sell the following described real estate at ABSOLUTE AUCTION:
MAYSVILLE - 1240 FOREST AVENUE - Two story frame home over basement. Home has exterior elements of brick, limestone and sandstone (native stone), timber frame, and stucco. Home provides for 2 upper level bdrms. and 1.5 baths (half bath on main level, full bath on upper level), with living room, dining room (dining room could provide for a main level third bedroom), and kitchen. Home served with central heat and central air, with updated electric and recent roof. Additional enhancements include hardwood floors, a custom front entry door, arched interior openings, nice staircase banister, decorative brick fireplace (non-functional), covered front porch, and a screened-in rear porch. On-street parking along Forest Avenue, with access in rear by alley providing for one-car garage and off-street parking area. Roof has been recently replaced, with some updated wallboard and remodeling, and updated electrical service.

LEGAL DESCRIPTION
     1240 FOREST AVENUE, MAYSVILLE, KY 41056 - That cerain lot or parcdel of ground, lying and being in Mason County, Kentucky just outside and South of the Sixth Ward of the City of Maysville, Fronting thirty (30 feet ont he South Side of Forest Avenue and running back south the same width one hundred sixty (160) feet to an alley; being bounded on the east by the property of Edward Sunier, on the south ty the alley aforesaid, and on the west by the property of Paul Muehlbauer, and on the north by Forest Avenue and being the same property which was conveyd M. R. Hirshfeld by H. D. Bryant and wife by deed dated November 21, 1935, recorded in Deed Book 135 page 268 Mason County Court Clerk's Office Records.  
      The property was conveyed to Kate Rains by deed of M. R. Hirshfeld and Annie Hirshfeld by deed dated the 19th day of September, 1940, said deed recorded in Deed Book 138 page 229, Mason County Court Clerk Records. Kate Rains died without a will, survived by her legal heirs at law her husband Clint Rains and their daughter, Helen Rains. By terms of the Will of Clint Rains, all real and personal property belonging to him were conveyed to Helen Rains, said Will recorded in Will Book 7 page 117 Mason County Court Clerk Records. Helen Rains passed away Dec. 2, 2018 with a Will, and Kaye Sherman Cobb and Bilie Paul Cobb were appointed Co-Executrix/Co-Executor by Campbell County Kentucky Probate Court Case # 18-P-00544. Kaye Sherman Cobb and Billie Paul Cobb authorized the sale of the subject property at ABSOLUTE AUCTION. 

TERMS & CONDITION OF SALE
      The Property is to be Sold upon the following Terms/Conditions: TERMS OF PURCHASE, REAL ESTATE: Property sold at ABSOLUTE AUCTION, to the highest and best bidder regardless of price, NO RESERVE (the Co-Executrix/Co-Executor have been provided with the definition of ABSOLUTE AUCTION as adopted by the Kentucky Board of Auctioneers and the auction shall comply with the terms of said definition). Purchaser(s) of real estate to place a NON-REFUNDABLE deposit (cash or good check) equal to 10 percent of the total purchase price with contract immediately following sale, with balance due in full with deed at closing on or before the 21st day of October, 2019. Terms of purchase are Cash to Seller: NO CONTINGENCIES OF ANY KIND PERMITTED. Possession with deed at closing. Sellers to maintain insurance on property though date of closing (including liability; agent/auctioneer is not responsible for accidents); however successful purchaser will have an inherent and thus an insurable interest in the property as of date of sale and is encouraged to obtain insurance immediately upon sale as purchaser will assume risk of loss from under-insurance, lack of insurance, or in the event or case of fire or other disaster. Year 2019 real estate taxes to be payable by the purchaser (NO PRORATION), however any prior years taxes not current and paid shall be payable by the seller. Prospective purchasers are encouraged and advised to inspect the property thoroughly prior to sale as REAL ESTATE SOLD “AS IS” WITHOUT WARRANTY WHATSOEVER -- INCLUDING WITH REGARD TO FITNESS/MERCHANTABILITY/MARKETABILITY/ DESIRABILITY FOR ANY USE -- EITHER EXPRESSED OR IMPLIED. Purchased subject to zoning, easements, highway right of way, local ordinances, and restrictions. Further the property shall be purchased by the existing legal description(s), by the boundary and not by the acre, subject to any facts that might be disclosed by an accurate survey --- sellers are not responsible for providing for any surveys of the subject property. The home on the subject property was constructed prior to 1978, thus Lead-Based Paint could potentially be in evidence. Purchasers concerned about the possible presence of lead-based paint are encouraged to arrange and conduct --- at the prospective purchaser’s sole expense --- any inspections for the presence of Lead-Based Paint they so desire prior to purchase, as purchaser will be required to waive the rights to any contingency relative to any future testing or presence of Lead-Based Paint as a condition of purchase. Purchasers must have performed any and all due diligence inspections of the property prior to purchase, at purchaser’s sole expense --- including but not limited to: Whole House Inspection, Wood-Boring Insect Inspection, Radon Gas Inspection, Lead-Based Paint Presence, Phase I/II/III environmental hazard reports/ surveys, property surveys, appraisal, etc. --- as purchaser will not be permitted any contingencies for any type of testing or results thereof determined after the auction. Contact agent/ auctioneer prior to the auction to arrange inspection/testing. Announcements made date of sale take precedence over printed matter. Payment of down payment for real estate required to be paid to the agent/auctioneer immediately upon conclusion of sale, at SALE SITE, NO EXCEPTIONS. NOTE: Any returned checks shall be subject to a $50 returned check fee (plus expenses of collection), a 10 percent penalty, shall be subject to interest and other expenses to the limit the law permits, and checks will be turned over for prosecution.
