NOTE: By virtue of an Order of the Circuit Court for Washington County, Maryland, Circuit Court Case No. 21-C-16-057849, dated August 15, 2017, the undersigned Court-Appointed Trustee will offer at public sale, the following described real property:

REAL ESTATE with improvements located in Hagerstown, Washington County, Maryland’s 27th District at 13522 Marsh Pike, Hagerstown better described in Liber 00760, Folio 00354 and at Tax Map 0025, Grid 0013, Parcel 0190.  The property will be conveyed together with and subject to all applicable conditions, restrictions, covenants, limitations, rights of way, streets, alleys, reservations, easements and appurtenances of record.

This two story brick home is conveniently located just outside the city limits near an elementary school and shopping district with easy access to the interstate. The home is all brick, with a vinyl sided addition in rear, composite roof, replacement windows, front porch, small rear deck, fenced rear yard, storage shed and off street parking. The home contains a living room and dining room with hardwood floors, kitchen, family room, half bath and utility area for washer and dryer on the first floor.  There are three bedrooms with hardwood floors, one full bath and hall linen closet on second floor.  The home has a basement with utility sink, full attic with potential for additional living space.  A deposit of Ten Thousand and 00/100 ($10,0000.00) DOLLARS will be required in cash or by certified check at the time of sale, the balance to be paid in cash or certified funds upon ratification of the sale by the Circuit Court for Washington County, Maryland, TIME BEING OF THE ESSENCE.  Interest shall accrue on the unpaid balance of the purchase price at the rate of Five (5%) Percent per annum from the date of sale to the date of settlement.  If Purchaser does not settle within ten (10) days from the date of ratification of sale, the deposit of the Purchaser may be forfeited, the property resold at the risk and expense of the defaulting Purchaser, and any other appropriate remedy may be utilized in the sole discretion of the Trustee.  If ratification or settlement is delayed for any reason, there shall be no abatement of interest.  Taxes, water, sewer, and other public charges and assessments payable on an annual basis shall be pro‑rated on and as of the date of said sale and shall be assumed thereafter by purchasers.  Purchasers shall pay the costs of all documentary stamps, transfer taxes, agricultural transfer taxes, if any, document preparation, title insurance, and other costs of settlement.  The undersigned specifically reserves the right to reject any bids submitted.  If Trustee is unable to convey good and marketable title, Purchaser’s sole remedy in law or equity shall be limited to the refund of the deposit to Purchaser; upon refund of the deposit, the sale shall be void and of no effect, and Purchaser shall have no further claim against Trustee.  Purchaser is responsible for obtaining physical possession of the property and assumes risk of loss or damage to the property from the date of sale.  The property with improvements is being sold in an “AS IS” condition and without any warranties, either expressed or implied, as to the nature, condition or description of the improvements, if any, and no warranty as to title will be given, expressed or implied.  In addition, the purchaser shall be responsible for any and all outstanding housing and zoning code violations and subject to any and all environmental problems and violations which may exist on or with respect to the property.
