     REAL ESTATE DESCRIPTION: APPROXIMATELY 245 ACRES MORE OR LESS being the same property conveyed to Albert Wilson and Ruby E. Wilson, husband and wife as joint tenants with right of survivorship and not as tenants in common, by deed of Albert Wilson and Ruby Wilson, husband and wife, by deed dated the 27th day of January, 1976, and recorded in Deed Book 125 page 585, Lewis County Court Clerk Records and described as consisting of 252 acres, a surveyed boundary, subject however to the following exceptions: Lot 4 consisting of 1.729 acres and further subject to a 12' easement conveyed to Jackie D. Riley and Rhonda G. Riley by deed dated the 1st day of April, 2003 and recorded in Deed Book 198 page 489, Lewis County Court Clerk Records. Lot 3 consisting of 1.467 acres conveyed to Larry G. Howard and Vickie S. Howard by deed dated the 1st day of April, 2003 and recorded in Deed Book 198 page 489, Lewis County Court Clerk Records. Lot 1 consisting of 1.605 acres conveyed to Maurice Gilliam and Ruth Pauline Gilliam by deed dated the 1st day of April, 2003 and recorded in Deed Book 198 page 544 Lewis County Court Clerk Records. Lot # 2 consisting of 1.478 acres conveyed to Franklin D. Mawk and Phyllis L. Mawk by deed dated the 1st day of July, 2003 and recorded in Deed Book 199 page 8, Lewis County Court Clerk Records. Further the property is subject to a Deed of Easement 30' in width from Albert Wilson and Ruby Wilson husband and wife to James W. Esham et ux by deed dated the 3rd day of July, 2002 and recorded in Deed Book 195 page 447 Lewis County Court Clerk Records. Further the property is subject to a Deed of Easement from Albert Wilson and Ruby Wilson husband and wife, to the Lewis County Water Association, said deed dated the 14th day of March, 1994 and recorded in Right of Way Book 5, page 420 Lewis County Court Clerk Records. After deducting the acreage of the exception from the original conveyed boundary, the remaining acreage is 245.721 acres, say 245 acres more or less. The said Albert Wilson passed away, vesting fee simple title in Ruby E. Wilson by virtue of the survivorship clause within the deed referenced above. Ruby E. Wilson passed away the 21st day of September, 2017 and by the terms of her Last Will and Testament as recorded in Will Book 3 page 383, devised her interest in the property to her children Ruth Pauline Gilliam, Vickie Sue Howard, Phyllis Lynn Mawk and Rhonda Gail Riley. On February 27, 2018, a motion was entered into by Douglas Wilson as the Executor of the Estate of Ruby E. Wilson granting him authority to sell teal estate of sale decedent at public auction pursuant to KRS 389A.010, with proper notice provided to all required parties with Judge Brian C. McCloud signing an order authorizing the Executor Douglas Wilson to enter into an agreement to have the property sold, said agreement dated the 10th day of April, 2018.

     REASON FOR SALE: The property described herein is being sold to settle the Estate of Ruby E. Wilson, authorized by Douglas Wilson as Executor thereof. Estate Attorney Thomas Bertram II, Vanceburg, KY.

 

   The Property is to be Sold upon the following Terms/Conditions: TERMS OF PURCHASE, REAL ESTATE: Property sold to settle the Estate of RUBY WILSON as authorized by Douglas Wilson, Executor of the Estate of Ruby E. Wilson, with the property to be sold at ABSOLUTE AUCTION to the highest and best bidder, regardless of price (the definition of Absolute Auction as adopted by the Kentucky Board of Auctioneers has been provided to the Executor and attached to this contract as an addendum. The Executor acknowledges an understanding of the definition and agrees that the auction shall be conducted in accordance with said definition). Purchaser(s) of real estate to place a NON-REFUNDABLE deposit (cash or good check) equal to 10 percent of the total purchase price with contract immediately following sale, with balance due in full with deed at closing on or before the 26th day of June, 2018. Terms of purchase are Cash to Seller: NO CONTINGENCIES OF ANY KIND PERMITTED. Possession with deed at closing (the purchaser shall have the right to close early in order to utilize any crop rights but no possessive rights shall take effect until such time as the property has been paid for in full and deed transferred to the purchaser). Sellers to maintain insurance on property though date of closing (including liability; agent/auctioneer is not responsible for accidents); however successful purchaser will have an inherent and thus an insurable interest in the property as of date of sale and is encouraged to obtain insurance immediately upon sale as purchaser will assume risk of loss from under-insurance, lack of insurance, or in the event of fire or other disaster. Year 2017 real estate taxes to be payable by the purchaser (NO PRORATION), however any prior years taxes that may have been unpaid shall be payable by the seller. Prospective purchasers encouraged/advised to inspect the property thoroughly prior to sale as REAL ESTATE SOLD “AS IS” WITHOUT WARRANTY WHATSOEVER --- INCLUDING WITH REGARD TO FITNESS/ MERCHANTABILITY/MARKETABILITY/ DESIRABILITY FOR ANUY USE WHATSOEVER – EITHER EXPRESSED OR IMPLIED. Purchased subject to zoning, easements, highway right of way, local ordinances, and restrictions. Further the property shall be purchased by the existing legal description, by the boundary and not by the acre, subject to any facts that might be disclosed by an accurate survey --- sellers are not responsible for providing for any surveys of the subject property. The home on the property was constructed prior to 1978, thus Lead-Based Paint could potentially be in evidence. Purchasers concerned about the possible presence of lead-based paint are encouraged to arrange and conduct --- at the prospective purchaser’s sole expense --- any inspections for the presence of Lead-Based Paint they so desire prior to purchase, as purchaser will be required to waive the rights to any contingency relative to any future testing or presence of Lead-Based Paint as a condition of purchase.
