BLOCK AUCTION TERMS AND CONDITION OF THE SALE: These terms are subject to amendments and modifications announced by the Auctioneer at the time of the auction. Any person participating in the auction shall be bound by the following terms and conditions. The Auctioneer does not warrant the accuracy, genuineness, authenticity, description, weight, count or measure of any listings specified herein. All Hours on Equipment were recorded during the time of listing and may change due to use prior to auction. All announcements during auction supersedes any printed advertising.
All bidders must register immediately upon entering the site. Everything will be sold according to Auctioneers Terms and Conditions. No pick-up of merchandise shall be made until items have been paid for. All payments may be made by cash, certified check, company check with a bank letter of authorization guaranteeing irrevocable payment to Block Auction, or major credit card. There will be a 5% convenience fee charged for all credit card usage.
International Buyers - a 25% deposit of your expected purchases must be received no less than 24hrs. prior to auction.
All sales are final, on an "As is", "Where is", In Place, "With all faults" basis with no conditions or warranties, whether expressed, implied, statutory or otherwise, including without limitation, warranties or conditions as to title, description, fitness for purpose, quantity, merchantability, state conditions, location or otherwise. By submitting a bid, the buyer/bidder affirms he has inspected all items before bidding. Purchasers shall be deemed to have relied entirely upon their own inspection and investigations.

PAYMENT:
Visa, Mastercard, Bank letter of guarantee, or Wire Transfers accepted as Payment.
A Convenience Fee of 5% will be charged on all items paid by Mastercard or Visa.
BANK LETTER OF GUARANTEE AND/OR CREDIT CARD PRE AUTHORIZATION:
To write a cheque for purchases online, a letter of guarantee from your financial institution is needed to guarantee funds to approve your desired bid limit and to verify available funds. You must pay for purchases with a cheque based on this account only, and no stop payment will be issued.

Date, Bidder’s Name and Address, Phone number, Fax number, Name and Date of Auction, Item to Bid and Bidding Limit.
Bank letter of guarantee or Pre authorized credit card must be received by Block Realty & Auction no later than 48 hours prior to sale date. Payment must be made by the next banking day following the auction.
All articles of merchandise are offered “As Is” and “Where Is” in units of measure as announced at the time of sale.
No claim will be considered for allowance adjustment of recession of any sale based upon the failure of the property to correspond to any particular standards or expectations of the buyer; Auctioneer may state the year of manufacture of certain equipment, however it is the responsibility of the buyer to ascertain, by his own means the correctness of year, model prior to bidding. The Auctioneer reserves the right to group, modify, increase, diminish or delete lots at his sole and absolute discretion.
IF FOR ANY REASON WHATSOEVER THE AUCTIONEER FAILS TO DELIVER AN AWARDED LOT, THE AUCTIONEER’S SOLE LIABILITY SHALL BE THE RETURN OF ANY DEPOSIT OR MONIES PAID FOR SUCH NON-DELIVERED LOT; THIS DOES NOT INCLUDE LOST OR STOLEN ITEMS.

All property is sold “AS IS”, and ALL SALES ARE FINAL. Property is open to thorough public inspection. It is the Bidder’s responsibility to determine condition, age, genuineness, value or any other determinative factor. Block Realty & Auction may attempt to describe the merchandise in advertising, on the Internet and at the auction but makes no representations. In no event shall Block Realty & Auction be held responsible for having made or implied any warranty of merchantability or fitness for a particular purpose. Bidder shall be the sole judge of value.
Purchases become the responsibility of and shall be and remain at the risk of the purchaser immediately upon acceptance of his bid. It shall be the responsibility of the purchaser to insure his purchases immediately.
No lots may be removed until the conclusion of the auction; although, invoices are available for payment at any time. All lots must be removed within the time announced or posted at the sale at buyer’s sole cost and risk, and only in a manner approved by the auctioneer. If for any reason, the buyer fails to remove any lots within the time specified, the lots shall be deemed abandoned and the auctioneer may re-sale, or remove from the auction site and/or store the said lots at buyer’s sole risk and expense. In addition, buyer shall be liable for any rent incurred or damages suffered by the auctioneer because of the buyer’s failure to timely remove any lot. Prior to the commencement of dismantling, rigging or cutting or any operation affecting buildings or land, buyer shall furnish certificates satisfactory to auctioneer, holding auctioneer harmless for any claims concerning damage or injury to persons or property arising out of any such acts. All equipment used in connection with removal shall itself be removed with the purchased lots.
