     UNDER AND BY VIRTUE of the authority contained in a certain Order entered by the Honorable Julia Byrd, Assistant Clerk of Superior Court for the County of Wilkes on October 12, 2017, in a special proceeding therein entitled The Estate of Darlene Virginia Sheets, by and through Timothy B. Joines, Administrator, Shawna S. Gilreath and Daniel Scott Moore, Petitioners, vs. Casey Church, by and through her duly appointed Guardian ad Litem, Davy B. Foster, Respondent, designated as 2016 SP 123, the undersigned Commissioner, by and through Great State Auction Company and, in particular, Randall Woodruff, will on November 17, 2017, at 1:00 p.m. on the grounds of the property described herein located at 344 Old Lankford Road, North Wilkesboro, NC 28659, that certain tract or parcel of land located in North Wilkesboro Township, Wilkes County, North Carolina, and more particularly described as follows:
LYING and BEING in North Wilkesboro Township, Wilkes County, North Carolina
PORTION OF PARCEL ID:  1402531

BEGINNING on an iron pin set on the east side of Old Lankford Road (S.R. #1518), a common corner to Tract #1 of the division of the Estate of Darlene Sheets.

Thence with said Tract #1, North 57° 53’ 37” East 182.32 feet to an iron pin set in a property line of Thomas Holland, Deed Book 635 Page 719, said iron pin set being located South 13° 22’ 42” East 10.56 feet from an iron pin found.

Thence with the property of Thomas Holland, South 13° 22’ 42” East 89.51 feet to an iron pin found. Thence South 26° 44’ 59” East 68.15 feet to an iron pin found, a common corner to Michael and Ina Jean Lankford, Deed Book 829 Page 289, and said iron pin found being located North 28° 37’ 55” West 31.31 feet from an iron pin found.

Thence with the property of Michael and Ina Jean Lankford, South 58° 00’ 00” West 157.00 feet to an iron pin set on the east side of Old Lankford Road.

Thence running North 32° 00’ 00” West 30.00 feet to a point in a cement driveway. Thence North 27° 33’ 36” West 122.72 feet to the Point of Beginning.

Containing 0.58 acres by coordinate calculations.

Reference: Being a portion of Deed Book 566 Page 602.

Surveyed by Gale W. Maiden, PLS, L-4400.

This sale is subject to ad valorem taxes and such other liens as may appear of record.
1.    The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.” The Commissioner makes no representations or warranties relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed. This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments.
2.    The successful (highest) bidder shall be required to make a cash deposit at the time of sale in the amount of five percent (5%) of the highest bid. Any successful bidder shall be required to tender the full balance of the purchase price so bid, including the five percent (5%) buyer’s premium as set out hereinafter, in cash or certified check at the time the undersigned commissioner tenders, or attempts to tender, to the successful bidder, a deed for the property. Should the successful bidder fail to pay the full balance of the purchase price so bid at that time, and the five percent (5%) buyer’s premium, the successful bidder shall remain liable on the bid as by law provided.
3.    This sale shall be held open for upset bids as by law provided.
4.    This sale is made pursuant to Chapter 1, Article 29A of the North Carolina General Statutes.
5.    The successful bidder’s inability to secure a loan for the balance of the sale proceeds is not an excuse to void the sale/purchase.
