Real Estate Terms:
Information: All information contained in this brochure and/or related
materials are believed to be accurate but are not warranted, and the sellers
and the auction company assume no liability for its accuracy. Prospective buyers are advised to rely
on their own due diligence, information and independent inspections for
verification. Information contained in the brochure and related materials shall
be subject to the terms and conditions in the purchase agreement. Real
estate is being sold in an As is, where is condition, with faults and with no
expressed or implied warranties by the seller or 326 Auctions, Inc.
Successful bidder(s) will be required to enter into an irrevocable purchase
agreement immediately following the closing of the bidding process. The final
bid shall be subject to the sellers acceptance or rejection within 48 forty
eight hours after the close of the bidding process. Seller shall also
execute a Lead Based Paint Disclosure and a Residential Sales Disclosure at the
end of the auction.
Non-Refundable earnest money down payment of 10% percent of the total purchase
price or $2,500 (whichever is greater) is due immediately at the close of the
auction. The balance will be due and payable in full upon delivery of
merchantable title and warranty deed. The down payment may be in the form of
cash, money order, cashiers check or personal check. Checks must be made
payable to 326 Auctions, Inc. and will be deposited only if the bid is
accepted. Your bidding is not contingent on financing, so be sure you have
financing arranged, if needed, and are capable of paying cash at closing.
will furnish an owners policy of title insurance in the amount of the purchase
price. Cost of the owners policy to be split equally. Title to the property
will be conveyed by the General Warranty Deed.
Taxes: Shall be prorated to the day of closing.
Information: Closing will take place within 30 days after proof of an insurable
title. The balance of the purchase price will be due in cash at closing and any
fees charge by a closing agent or
persons acting in such capacity shall be shared equally between buyer and
survey required by the buyer or the buyers lender will be paid for by the
326 Auctions, Inc and their representatives are exclusive agents of the seller.
Personal Property Terms:

Buyers are buying under their own inspection. Acceptable forms of payment are Cash, Good
Check, or Credit Card (credit card purchases with have a 3% convenience fee
added to bid price). All checks without
irrevocable bank letter of guarantee will be subject to Auction Company
approval and or Seller approval. 326
Auctions & the seller reserve the right to hold items paid for with
personal check until negotiable funds have been secured. All items must be removed sale day with no
exceptions. 326 Auctions & the
seller reserve the right to deny or revoke bidding privileges at any time. 326 Auctions & the seller are not
responsible for accidents. A ten percent buyer premium will be added to the bid price to determine the final sales price.
ANNOUNCEMENTS MADE BY THE AUCTIONEER ON AUCTION DAY SHALL HAVE PRECEDENCE OVER
PREVIOUSLY PRINTED MATERIALS OR ORAL STATEMENTS MADE!
