STATE OF NORTH CAROLINA, COUNTY OF WILKES, IN THE GENERAL COURT OF JUSTICE, SUPERIOR COURT DIVISION, BEFORE THE CLERK, 2016 SP 78, J. RODNEY CAUDILL, Administrator CTA of the Estate of James Monroe Barrett, Petitioner, vs. BOYD BRICKEY, Respondents.

UNDER AND BY VIRTUE of the authority contained in a certain Order entered by the Honorable Julia Byrd, Assistant Clerk of Superior Court for the County of Wilkes on the 23RD day of September, 2016, in a special proceeding therein entitled “J. Rodney Caudill, Administrator CTA of the Estate of James Monroe Barrett, vs. Boyd Brickey, Respondent,” designated as 16 SP 78, the undersigned Commissioner will on Friday, October 28, 2016, at 1:00 p.m., on the grounds of the said real property, specifically,  3659 Bethel Road, Jonesville, North Carolina, offer for sale to the highest bidder for cash, that certain tract or parcel of land located in New Castle Township, Wilkes County, North Carolina, recorded in Book 705 at Page 615 of the Wilkes County Registry, Parcel #1301299, and more particularly described as follows:
BEGINNING at a point in the centerline of Bethel Church Road, S.R. 2307, said Beginning point being located North 43 deg. 26’ 13” East 1,590.98 feet from a RR spike set in the centerline of S.R. 2307 at the point where it crosses the center of a box culvert; and running from the Beginning point, and with the centerline of S.R. 2307; South 88 degs. 10’ 59” West 36.42 feet to a point in the centerline of S.R. 2307; thence, continuing with the centerline of S.R. 2307 as it curves to the left, such curve having a Radius of 274.95 feet, a length of 165.00 feet, a Delta of 34 deg. 22’ 57”, and a Chord Bearing and Distance of South 69 degs. 58’ 42” West 162.53 feet to a point in the centerline of S.R. 2307; thence, continuing with the centerline of S.R. 2307 as it curves to the left, such curve having a Radius of 524.99 feet, a Length of 109.00 feet, a Delta of 11 degs. 53’ 45” and a Chord Bearing and Distance of South 45 degs. 27’ 33” West 108.80 feet to a point in the centerline of S.R. 2307; thence, leaving the centerline of S.R. 2307, and running with the line of Barry D. Suddreth as shown on deed from the Wolfe Estate recorded this day, North 75 degs. 37’ 23” West 40.77 feet to a ¾ inch New Iron Pipe; thence continuing with the Suddreth line, South 79 degs. 14’ 38” West 187.71 feet to a 1 inch New Iron Pipe, North 11 degs. 51’ 50” West, passing through a ¾ inch New Iron Pipe at 260.01 feet, a total distance of 469.65 feet to a 1 inch New Iron Pipe, North 89 degs. 06’ 30” East 569.29 feet to a 1 inch New Iron Pipe, South 04 27’ 33” West 168.44 feet to a ¾ inch New Iron Pipe, and then South 12 degs. 16’ 13” East, passing through a ¾ inch New Iron Pipe set in the North right of way line of S.R. 2307 at 115.34 feet, a total distance of 145.85 feet to the Beginning point, containing 4.769 acres, more or less, as shown on plat of survey of James R. Smith, Jr., R.L.S. #L-2722, which plat is entitled “Plat of Survey for Norma N.M. Wolfe Estate,” and dated 7/07/92, a photocopy of the relevant portions of which is hereto attached and made a part of this instrument.

This sale is subject to ad valorem taxes and such other liens as may appear of record.

1.    The property to be offered pursuant to this notice of sale is being offered for sale, transfer and conveyance “AS IS, WHERE IS.”  The Commissioner makes no representations or warranties relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition expressly are disclaimed.  This sale is made subject to all prior liens and encumbrances, and unpaid taxes and assessments.
2.    The successful (highest) bidder shall be required to make a cash deposit at the time of sale in the amount of 5% of the highest bid.  Any successful bidder shall be required to tender the full balance of the purchase price so bid, including the ten percent (10%) buyer’s premium as set out hereinafter, in cash or certified check at the time the undersigned Commissioner tenders, or attempts to tender, to the successful bidder, a deed for the property.  Should the successful bidder fail to pay the full balance of the purchase price so bid at that time, and the ten percent (10%) buyer’s premium, the successful bidder shall remain liable on the bid as by law provided.
3.    This sale shall be held open ten (10) days for upset bids as by law provided.
4.    This sale is made pursuant to Chapter 1, Article 29A of the North Carolina General Statutes.
5.    Randall Woodruff of Great State Auction Company is the agent of the undersigned Commissioner.  Broker and seller have agreed that this sale is to be conducted by including a buyer’s premium of ten percent (10%) upon the final high bid price accepted by the Court.  The actual contract sales price shall be the sum of the confirmed high bid plus the buyer’s premium of ten percent (10%) of said high bid.  Any bidder acknowledges and agrees that inclusion and/or payment of the buyer’s premium shall not make broker the agent of the bidder/buyer and that the broker continues as the agent of the Commissioner in the sale of said property.

6.    The successful bidder’s inability to secure a loan for the balance of the sale proceeds is not an excuse to void the sale/purchase.
