Terms of Real Estate Auction:

 

-DOWN PAYMENT: Buyer shall pay $5,000 down payment on the day of auction with the balance in cash at closing. The down payment may be made in the form of cashier’s check, personal check, or corporate check. Purchase is not conditional upon financing, so buyers must be sure to have arranged financing and are capable of paying cash at closing.

-ACCEPTANCE OF BID PRICES: Final bid price is subject to Seller’s acceptance.

-PURCHASE AGREEMENT AND DISCLOSURE: Buyer shall be required to enter into a purchase agreement at the auction site immediately following close of the auction. Buyer shall also sign Lead-Based Paint disclosure form.

-TITLE / DEED / CLOSING: Seller shall provide an owners title insurance policy in the amount of the purchase price. Seller shall provide a Warranty Deed. The balance of the purchase price is due at closing, which shall take place within 40 days of auction. Costs for an insured closing shall be shared 50:50 between Buyer and Seller.

-POSSESSION: Possession shall be transferred on day of closing, immediately following the closing.

-BROKER PARTICIPATION: Broker participation paid with pre-registration; contact AAA Auction Service, Inc. for details.

-REAL ESTATE TAXES: The Real Estate taxes shall be pro-rated to the day of closing.

-ACREAGE: All tract acreage, dimensions, and proposed boundaries are approximate and have been estimated based on current legal descriptions and/or aerial photo.

-SURVEY: No survey shall be provided by the seller.

-AGENCY: AAA Auction Service, Inc., and its representatives are exclusive agents of the Seller.

-DISCLAIMER AND ABSENCE OF WARRANTIES: All information contained in this brochure and all related materials are subject to the terms and conditions outlined in the Purchase Agreement.
