AUCTION TERMS & PROCEDURES

Offered at PUBLIC AUCTION on Thursday, October 20, 2016 at 5:30 pm and will be the real estate consisting of three (3) lots to be sold individually and are located on Arthur Curry Road, Liberty, IN. Auction site will be at Lot 28. Said property is co-owned by Melvin William Curry, Vickie S. Cox, David C. Curry, and James M. Curry, Jr. and sells subject to the owner’s confirmation. There will be open bidding as determined by the auctioneer.

Legal: Lot 1: (LOT 45 - 3.22 acres) Pleasant View S. D. Lot 45 11-10-02; Lot 2 (LOT 28 - 1.04 acres) Pleasant View S.D. 11-10-02 and Lot 3 (LOT 30 - 1.14 acres) Pleasant View S. D. 11-10-02. All three lots are situated in Harmony Township, Union County, IN.

UTILITIES: Franklin County Water Association available.

DOWN PAYMENT: 10% down payment on auction day with balance due within (30) thirty days at closing. Down payment may be made in the form of cash, cashier’s check, personal check or corporate check. Your bidding is not conditional upon financing, so be sure you have that arranged, if needed, and are capable of paying cash at closing.

TAXES: Said properties (#1 Lot 45: 81-11-11-302-045.000-004 approx. $87.07 per 1/2 yr. ; (#2 Lot 28: 81-11-11-302-028.000-004 approx. $27.51 per 1/2 yr.; (#3 –Lot 30: 81-11-11-302-030.000-004) approx. $30.17 per 1/2 yr. Said taxes are currently for the year 2015, payable 2016 , with no exemptions. Buyer's will assume taxes in the Spring of 2017 (for year 2016) and thereafter. Buyer(s) will be responsible for filing their own pertinent exemptions. Seller(s) will have satisfied all previous taxes at final closing.

ACCEPTANCE OF BID PRICES: Successful bidders will be required to enter into a purchase agreement at the auction site & immediately following the auction. All final bid prices are subject to sellers’ acceptance or rejection.

EVIDENCE OF TITLE: Seller(s) shall provide an Owner’s Title Insurance Policy in the amount of the purchase price.

ZONING: Residential DEED: Seller(s) shall provide warranty deed.

CLOSING: The balance of the Real Estate purchase price is due at closing to be held within (30) thirty days following auction – on or before November 19, 2016. Cost for an administered closing will be shared 50/50 between buyer(s) and seller(s). Buyer(s) pay any closing charges due to Buyer(s) securing a mortgage.

POSSESSION: Possession is given day of final closing.

ACREAGE: All boundaries are approximate and have been estimated based on current legal descriptions.

EASEMENTS: Sale of property is subject to any and all easements of record.

AGENCY: Abernathy Auction & Real Estate Company and its representatives are exclusive agents of the seller.
