TERMS AND CONDITIONS: All property is sold as-is, where is, without recourse and all sales are final. No Refunds or Returns. As a condition to registration and bidding, bidder agrees that they will not, under any circumstances, initiate a chargeback, and agree that they are waiving any chargeback rights that may exist under the agreement between the bidder and the bidder's credit card company. Bidders agrees that, should a chargeback be initiated, the bidder terms and conditions will be conclusive evidence of the bidder's waiver of any chargeback rights. Bidder agrees if a chargeback is successful, the buyer remains liable for the purchase price including any buyer's premium, plus costs of collection and attorney fees. Bidding at the auction indicates your acceptance of our terms and conditions of the sale.
All property is described to the best of our knowledge; however, neither we nor consignor make any warranty, expressed or implied, with respect to such property as to the physical condition, character, quality, rarity, authenticity, importance, authorship, provenance, medium, period, origin or estimated value, or other attributes of any sold lot. No statement anywhere, whether oral or written, whether made in the catalog or advertisement, bill of sale, gallery posting, announcement or remarks by staff or the Auctioneer, shall be a warranty, representation or assumption of liability. It is important to understand that South Jersey Auction has never, and would never, knowingly offer a fake or altered item for sale, and we offer no guarantee of authenticity of any item offered. All measurements and weights are approximate.
INSPECTION and Auction Facility LOCATION: This will fluctuate to reflect what is recommended by the CDC at current time. We are not open to the public. All Merchandise may be available for inspection and preview by appointment only at auction warehouse facility. NOTE: All items won online through AuctionZipLive and Invaluable bidding will not be available for pickup until Monday after the auction by single appointments utilizing a no contact outside shipping zone.
QUESTIONS must be submitted by Friday, May 29th, 8:00 pm (EST) so we may give your inquiry our full attention.
The Auctioneer has the absolute and sole discretion to refuse any bid and to advance the bidding in any manner. The Auctioneer also has the right to withdraw any lot, and in the case of error and dispute (whether during or after the sale) to determine the successful bidder, to continue the bidding, to cancel the sale or to re-offer and resell the property. The highest bidder acknowledged by the Auctioneer will be the purchaser. In the case of a tie bid, the winning bidder will be determined at the sole discretion of the Auctioneer. In the event of a dispute between bidders, the Auctioneer has final discretion to determine the successful bidder or to re-offer the lot in dispute. If any dispute arises after the sale, the sale record of the Auctioneer is conclusive. Participation in the Auction may be disallowed for any reason.
A bid is an offer to purchase and by making a successful bid, a bidder is accepting personal liability to pay the purchase price, plus the buyer's premium, all applicable taxes and all other applicable charges. The highest bidder acknowledged by the Auctioneer is the buyer. The Auctioneer is the sole determinant as to who is the successful bidder. Once the lot has sole the successful bidder immediately assumes full risk and responsibility for the purchased lot.
Bidding Increments: The Auctioneer will commence the bidding at any level and in increments considered appropriate. Bids will be sought in increments selected by the Auctioneer who will have the absolute discretion to select any increments for any lot and the discretion to vary the increments in the course of the bidding for any lot.
BUYER PREMIUM: There is a 25% Buyers Premium applied to each lot sold. Total purchase price will be: hammer price, buyer's premium and applicable taxes.
SALES TAX: No Sales Tax for out of state buyers or New Jersey Tax Exempt buyer. New Jersey exempt buyers must present appropriate tax exemption form(s) to South Jersey Auction before any exemption can be made. New Jersey recipients are required to pay state sales tax of 6.625% unless exempted by law.
PAYMENT: Payment must be received/arranged within four (3) days from auction date. Credit cards may be charged 3 days after auction date. South Jersey Auction accepts Cash, Known Check, Visa, MasterCard, Discover, American Express, Diners Club and Wire Transfer (at buyers expense) as payment for items purchased. Invoices will be emailed to the successful bidder within one (1) business day of the Auction. Due to the uncontrollable nature of the delivery of email, non-receipt of an 'Email Invoice' does not preclude you from your responsibilities for payment if you were a winning bidder. If you have participated in the Auction, you are encouraged to inquire regarding whether or not you were the winning bidder.
Please note that Auctionzip and Invaluable does not share your credit card information that you supply them to activate a bidder paddle with the our auction house.
South Jersey Auction reserves the right to move forward with any and all remedies available to us, including reporting your bad debt to the live Auction provider and/or any other related entities. Merchandise becomes the full responsibility of the Buyer at the close of the Auction, and the Buyer assumes all risk of loss and damage to property. By requesting to participate in any Auction, you acknowledge that you are legally bound by South Jersey Auction's terms and conditions herein. Please note that all emails received on a non-auction weekend will be answered on Monday morning.
SHIPPING: You will need to call or email South Jersey Auction to pay for the shipping of your purchases. No items will be released until full payment has been received and validated. You are responsible for paying in US DOLLAR currency. We will charge you for any differences and any conversion fees if not paid in US DOLLARS.
SHIPPING: Buyer pays and is responsible for all related shipping cost, insurance and arrangements. Buyer may request auction house assistance. Auction house is not a shipper. Due to covid-19, we can store purchases for FREE until your state and our state has ban has been lifted. Then we will resume the regular pick up shipping terms of... All items must be removed from the premises within five (5) days of the sale. After five (5) days, items remaining in South Jersey Auction's possession may be assessed a minimum storage fee of $5 per day based on size. Item(s) will be deemed abandoned if storage fees are not paid and accumulate to purchase price or after 30 days, whichever happens first. Pick up at 26 Repaupo Station Road, Logan Township, NJ 08085.
