This tract is best described as Tract 1 on the survey dated October 8, 2009 prepared by Choice One Engineering. Located on the West side of Fair Road just North of Schenk Road. Road Frontage on Fair Road. Currently zoned A1 (Agricultural).
TRACT 2: Situated in the County of Shelby, in the State of Ohio, and in the Township of Clinton containing 14.33 acres of productive bare ground. This tract is best described as Tract 2 on the survey dated October 8, 2009 prepared by Choice One Engineering. Loacted on the East side of Fair Road and North of Schenk Road. Road Frontage on both Fair and Schenk Roads. Currently zoned I2 (Heavy Industrial)
TRACT 3: Situated in the County of Shelby, in the State of Ohio, and in the Township of Orange containing 22.05 acres of productive bare ground. Located on the North side of Gearhart Road and West of Doorley Road, east of the Shelby County Jail. Road frontage on both Gearhart and Doorley roads. TERMS OF SALE: All Tracts will be sold and bids accepted only by the acre. Bids will be accepted on Tract 1 (25.249 acres), then Tract 2 (14.33 acres). Then bids will be accepted on the combination of Tracts 1 and 2 (the total 39.579 acres). The property will be sold in the manner resulting in the highest total selling price. Bids will then be accepted on Tract 3 (22.05 acres), then Tract 4 (42.23 acres). Then bids will be accepted on the combination of Tracts 3 and 4 (the total 64.28 acres). The property will be sold in the manner resulting in the highest total selling price. The four tracts will not be offered all together. Down payment requirements day of sale are $10,000 for each tract. Both combination tracts will each require $20,000 down payment day of the sale. Down payment may be in the form of cash, certified or cashier’s or personal check. Balance upon delivery of deed. Deed must be transferred on or before January 5, 2010. Possession of land after the 2009 harvest has been completed. Taxes will be prorated to the day of closing on all tracts. If the buyer chooses to use the real estate for any purpose that would result in there being a recoupment tax liability, the buyer will be required to repay those taxes as a result of this decision. Buyer must have financing arranged prior to day of sale. Bidding is not conditional upon financing approval. Both the seller and buyer will sign a written contract on the day of the sale. The property is being sold on an “as is where is basis” and no warranty of representation, either express or implied, concerning the property, is made by the seller, the auctioneer or Wagner Realty Co., Inc. All Statements made day of sale supersede all advertising. Although the seller has every intention of selling this real estate, they do reserve the right to refuse any and all bids.
