The property will be sold in “AS IS” condition, without warranty or guarantee either express or implied with respect to the nature and description of the improvements thereon, subject to all conditions, agreements, restrictions and covenants of record, affecting the same, if any. The property will also be sold subject to all encumbrances and such state of facts that a physical inspection of the property might disclose and agreements of record affecting the same, if any. In addition, the property will be sold subject to all existing housing, building and zoning code violations, and subject to all environmental problems and violations which may exist on or with respect to the property and subject to all matters and restrictions of record affecting the same, if any. Cost of all documentary stamps, transfer taxes, and all other charges incidental to the conveyance of the property to be borne by the Purchaser. In the event the Purchaser fails to go to settlement as required, the deposit shall be forfeited and the property resold at the risk and expense of the defaulting Purchaser. In the event Purchaser fails to comply with all terms and conditions of the sale, then all costs and expenses (including attorney fees), shall be the responsibility of Purchaser.
If Seller cannot convey good title, the purchaser’s sole remedy in law or in equity shall be a refund of the deposit and the sale shall be considered null and void and of no effect and the purchaser shall have no further claim against the Seller.
