Description of property: 122 acres +/- selling in one tract at absolute auction to the highest bidder. 93 acres +/- are tillable. Barns and two homes are included in this tract and will not sell separately.
Legal Description: The Southeast Quarter of the Southwest Quarter of Section Sixteen (16), Township Eighteen (18) North, Range Ten (10) West, excepting therefrom the following described tract, to-wit: Four Hundred Forty (440) feet of even width off of and from the east side of the above described tract of land. The East One-third (1/3rd) of the Southeast Quarter of the Southwest Quarter of Section Sixteen (16), Township Eighteen (18) North, Range Ten (10) West, containing thirteen and one-third (13 1/3) acres, more or less. The Northeast Quarter of the Southwest Quarter of Section Sixteen (16), Township Eighteen (18) North, Range Ten (10) West, containing forty (40) acres, more or less. Commencing at a stone set in the south line of the West Half of the Northwest Quarter of Section Sixteen (16), in Township Eighteen (18) North of Range Ten (10) West 2143 feet east of the southwest corner of the East Half of the Northeast Quarter of Section Seventeen (17), in Township Eighteen (18) North of Range Ten (10) West and from which point of beginning run north 619.4 feet, thence east 3339 feet, more or less, to the east line of the Northeast Fractional Quarter of said Section Sixteen (16), thence south 619.4 feet, more or less, to the south line of said Northeast Quarter, thence west 3339 feet, more or less, to the place of beginning, and containing in all forty-seven and forty-seven hundredths (47.47) acres, more or less. Keller, husband and wife, by warranty deed dated September 12, 1989, and recorded September 14, 1989, in Deed Record 148, page 534, in the office of the Recorder of Vermillion County, Indiana, to-wit: A part of the Southeast Quarter of Section 16, Township 18 North, Range 10 West of the Second Principal Meridian, located in Highland Township, Vermillion County, Indiana and described as follows: From the Southeast corner of the Southeast Quarter of Section 16, Township and Range aforesaid; proceed South 89 degrees 50 minutes 43 seconds West (an assumed Bearing) with the centerline of a county road for a distance of 1866.52 to a P.K. nail set and the point of beginning; thence South 85 degrees 50 minutes 43 seconds West for a distance of 575.00 feet; to a P.K. nail set thence North 0 degrees 20 minutes 00 seconds East passing a 5/8 inch rebar with cap set on the right-of-way of a county road for a distance of 375.00 feet to a 5/8 inch rebar with cap set; thence North 85 degrees 50 minutes 43 seconds East for a distance of 575.00 feet to a 5/8 inch rebar with cap set for a distance of 375.00 to the point of beginning containing 4.93 acres more or less, subject to highways, legal rights-of-way and easements of record.
Auction Procedure: Property to be sold in one tract. Property selling as-is, where-is, with no warranty of any nature expressed or implied. Selling at Absolute Auction with NO RESERVE PRICE.
Down Payment: $50,000 earnest money down day of auction. Earnest money can be in the form of personal check, corporate check or cashier's check and is non-refundable. Auction is not contingent upon potential buyer's financing.
Purchase Agreement: Successful bidder will be required to sign an Offer to Purchase agreement immediately following the close of the auction.
Possession: Possession day of closing subject to tenant's rights for 2009 crop year and renters' lease for houses 60 days after auction date.
Closing: Closing within 30 days following auction date. Balance of purchase price due at closing. Closing cost of insured closing will be shared as 50% from the seller and 50% from the buyer.
Taxes: Seller will pay 2008 taxes due 2009. Seller to credit 2009 taxes due 2010 to buyer at closing.
Inspection: Any bidder is responsible for conducting his/her own independent inspections prior to auction at bidder's expense.
Lead-Based Paint Disclosure: Successful bidder will be required to sign waiver of lead-based paint disclosure day of auction.
Evidence of Title: Seller shall provide an Owner's Title Insurance Policy in the amount of purchase price.
Deed: Seller shall provide Trustee Deed(s).
