TERMS & CONDITIONS
1) FULL PAYMENT SHALL BE MADE ON DATE OF SALE BEFORE BIDDER/BUYER LEAVES THE PREMISES.
a. Payment must be made by Cash or Indiana Check. All Checks over $ 500.00 must be accompanied by a bank letter of guarantee. No Exceptions!.
b. A 10% Buyers Fee will be charged on all items unless otherwise posted.
c. Sales Tax is not applicable to this Estate Sale.
d. WE DO NOT ACCEPT CREDIT CARDS!
2) NO WARRANTY. The descriptions of items appearing on any form of advertising either Print or Website prior to this sale are believed to be correct. Nevertheless, neither those descriptions nor any oral statement made by the Owner or Auction Company or Agents concerning any item shall be construed as a warranty, either expressed or implied. ITEMS ARE SOLD AS IS-WHERE IS with all Faults.
3) RECEIPT. A Buyer will be furnished a receipt at the time of payment. This receipt must be authenticated by the checkout person before Buyer will be permitted to remove purchases from the sales premises. Please Keep those receipts on your person and present them when picking up items.
4) REMOVAL DATE. Merchandise becomes the full responsibility of the BUYER when the Auctioneer says, SOLD, and Buyer assumes all risk of loss and damage to property until removed from the sales premises. Buyer and Auction Company agree that merchandise may remain on the sales premises for a period of time following the sale at the risk of the Buyer. The date by which all merchandise must be removed from the premises will be announced by Auction Company at the sale/or stated in writing posted at the auction premises. Bidder agrees to pay any storage charges assessed by the Auction Company on any item(s) not removed by bidder by the removal deadline, OR forfeit merchandise entirely, if premises are not available after designated removal period .
5) NO REFUND OF ADJUSTMENTS. There will be NO Adjustments made for lost or stolen items following the sale of an item. When the Auctioneer says, SOLD the item sold becomes the exclusive responsibility of the Buyer.
6) RESALE. The Auction Company reserves the right to resell any property not paid for in full on sale day. The Buyer shall be responsible to Auction Company for any expenses for resale and collection costs and damages or shortages resulting from resale.
7) DISPUTES BETWEEN BIDDERS. The Auctioneer shall designate the Buyer after each item of merchandise is auctioned. If a dispute arises between two or more bidders, The Auctioneer reserves the right to re-open bidding. His designation of the Buyer shall be final.
8) SAFETY. All attendees of this auction agree to hold harmless the Seller, Auction Company and its Agents and Employees, and Premises owner from costs associated from any injury as a result of attending the sale or removal of property. All parties understand that there is a level of risk associated with the removal of items at this sale and as an attendee of this sale, buyer agrees that they are qualified to remove sale items and accept responsibility for personal safety as well as any costs associated with injury or damage to person or property while attending the sale or removing items sold.
Everything sells to the highest bidder regardless of Price. No Reserves No Minimums. Final listing of this auction is subject to change with possible additions/deletions until auction time, All Items are sold as-is where-is with all faults with no warranties either express or guaranteed by the owner(s) or the auctioneer.
